The original first-instance judgment held that the defendant Wen X had nothing to do, repeatedly insulted and intimidated others, arbitrarily destroyed property on many occasions, and arbitrarily assaulted others, the circumstances were heinous, and his conduct constituted the crime of picking quarrels and provoking trouble. The prosecution was convicted of the offence charged. Defendant Wen X was previously sentenced to fixed-term imprisonment for an intentional crime, and within 5 years of the completion of the criminal punishment, he committed another crime that should be sentenced to fixed-term imprisonment or higher, and is a recidivist and should be given a heavier punishment in accordance with law.
