In December 2023, Ms. Wang, the person in charge of a bacon brand, saw a live investment advertisement on Douyin, and after an investigation, they signed a contract with Shanghai Shengchenze Advertising Media Co., Ltd. (hereinafter referred to as "Shengchenze Media").
"Shengchenze Media said that it is very easy for them to invite celebrities to do live broadcasts and endorsements. Ms. Wang told the Red Star Capital Bureau that they paid a pit fee of 100,000 yuan, and the other party promised to do two big anchor live broadcasts + some small anchors live broadcast goods, and guarantee 1:14, that is, the minimum sales of 1.4 million yuan, otherwise the same proportion will be refunded.
"Because our (product) is bacon, which is the best to sell a year ago, I was in a hurry, and they said that after paying the money, they would arrange some small anchors to broadcast, which would probably complete 30% of the sales, and the big anchors could do 50%, and the remaining 20% would be handed over to the second big anchor to return to the live broadcast. Ms. Wang recalled the scene to the Red Star Capital Bureau.
The contract shows: Shengchenze Media provides live streaming services, and each live broadcast artist is the industry's top talent, and the guests are stars. Ms. Wang told the Red Star Capital Bureau that Shengchenze Media had reminded them of the problem of explosive orders, so they prepared bacon products worth 1.7 million yuan, and the shelf life of these products was 180 days, but in the end only one order was sold, with sales of about 100 yuan.
"The promised ratio has not been completed, and we can't get the live broadcast slice of the same frame, and Shengchenze Media has no ability to execute this contract. Ms. Wang said that they asked for a refund for the termination of the contract, but they were repeatedly delayed by Shengchenze Media.

On January 25, Huang Shengyi's studio issued a statement saying that on January 16, Huang Shengyi and Yang Zi were invited by Douying Culture Media (Shanghai) Co., Ltd. (hereinafter referred to as "Douying Media") to help promote and bring goods as guests to the live broadcast room of @cousin (Qin Jinjin).
Huang Shengyi's studio emphasized that the two did not make any form of authorization such as investment promotion and any commitment to guarantee the quantity, and the two fully fulfilled the content of the contract, including the agreed live broadcast duration, and the need to help promote 30 designated products as guests.
"For any unauthorized use of the portrait or name of Huang Shengyi and Yang Zi for any form of commercial activities, we will resolutely pursue their legal responsibility. Huang Shengyi's studio said that they had urged Douying Media to strictly perform the contract with all merchants and brands as soon as possible, and properly handle the aftermath in a timely manner.

Regarding the failure to meet the promised sales amount and no refund, Mr. Wang explained that the contract is not for a single live broadcast, "We can't pin all our hopes on a live broadcast, but we will arrange for the anchor to continue to broadcast during the contract period." ”
Red Star Capital Bureau flipped through the three contracts and found that the cooperation period was indeed indicated in the contract, such as two live broadcasts in 90 days, three live broadcasts in 90 days, and three live broadcasts in 100 days (with a lineup of industry top talents + stars), and live broadcast slices can be provided.
Mr. Wang told the Red Star Capital Bureau that if the promised sales cannot be achieved within the cooperation period, they will strictly follow the contract and refund the same proportion, and will arrange other live broadcast sessions in the future, and also arrange employees to make live broadcast slices.
