On December 29, 2023, the Intermediate People's Court of Zhenjiang City, Jiangsu Province, publicly pronounced a verdict on the case of Cai Esheng, former member of the Party Committee and vice chairman of the China Banking Regulatory Commission, for accepting bribes, using influence to accept bribes, and abusing power, and sentenced the defendant Cai Esheng to death for the crime of accepting bribes, with a two-year reprieve, deprivation of political rights for life, and confiscation of all personal property. Parole: sentenced to 12 years' imprisonment and a fine of 5 million yuan for the crime of using influence to accept bribes; sentenced to 9 years' imprisonment for the crime of abuse of power, and decided to carry out the death sentence with a two-year reprieve, deprivation of political rights for life, and confiscation of all personal property, and after the two-year suspension of the death sentence is commuted to life imprisonment in accordance with law, he will be imprisoned for life without commutation or parole; Cai Esheng's criminal gains and fruits shall be recovered in accordance with the law and handed over to the state treasury.

After trial, it was ascertained that from 2006 to 2021, the defendant Cai Esheng took advantage of his position as a member of the party committee and vice chairman of the former China Banking Regulatory Commission, as well as the facilitation of his authority or status, to provide assistance to relevant units and individuals in matters such as financing loans, business contracting, and job promotion, and illegally accepted property directly or through others, totaling more than 407 million yuan. From 2018 to 2021, Cai Esheng took advantage of his position as a member of the Party Committee and vice chairman of the former China Banking Regulatory Commission or the facilitation of his position to provide assistance to relevant units and individuals in matters such as equity transfer, financing loans, and work adjustments through the conduct of other state employees in their positions, and illegally accepted property directly or through others, totaling more than RMB 110 million. From 2010 to 2013, while serving as a member of the Party Committee and vice chairman of the former China Banking Regulatory Commission, Cai Esheng violated laws, regulations and relevant provisions by engaging in favoritism and abusing his power in the course of performing his supervisory duties, causing major losses to public property and the interests of the state and the people, and the circumstances were particularly serious.

The Zhenjiang Intermediate People's Court held that defendant Cai Esheng's conduct constituted the crimes of accepting bribes, using influence to accept bribes, and abusing power. Cai Esheng should be sentenced to death for the crime of accepting bribes because the amount of bribes he accepted was particularly huge, the circumstances of his crime were particularly serious, the social impact was particularly vile, and he caused particularly heavy losses to the interests of the state and the people. In view of the fact that after Cai Esheng was brought into the case, he truthfully confessed all the facts of the crime, took the initiative to confess most of the facts of the crime of accepting bribes that the supervision organs had not yet grasped, that some of the bribes were attempted crimes, that he pleaded guilty and repented, and actively returned the stolen goods, and that most of the stolen money and goods had already been recovered from the case, and that there were statutory and discretionary mitigating circumstances, and that he was sentenced to death, and that he may not be immediately executed. On the basis of the facts and circumstances of Cai Esheng's crime and the serious harm caused to the state and society, it was decided that after the two-year suspension of his death sentence was completed and commuted to life imprisonment in accordance with law, he would be imprisoned for life without commutation or parole. The Court accordingly rendered the judgment.
