At the launching ceremony of the 2024 "Respecting the Law and Abiding by the Law, Building Dreams Together" Public Interest Legal Service Action for Employees of the Shanghai Federation of Trade Unions, the Jiading District Federation of Trade Unions has sharpened its sword for five years and compiled and printed the "White Paper on "Legal Physical Examination of Harmonious Labor Relations" officially launched in the city.

This white paper brings together the experience and practices of the Jiading District Federation of Trade Unions in promoting the "legal physical examination" service project of harmonious labor relations in the whole region since 2018, giving grassroots trade unions and enterprises the most intuitive, reference and comparative guidance and help.

As soon as the white paper was released, it was well received by enterprises and employees, and it also added a strong touch to the overall work of the Jiading trade union this year to adhere to the combination of legal rights protection and precise services, build harmonious labor relations, and promote the protection of employees' rights and interests.

"Check the pulse", prescribe more than 30 doses of "good medicine" for harmonious labor relations a year

Trade unions are an important force in promoting harmonious labor relations. As early as 2018, the Jiading District Federation of Trade Unions took the lead in innovating and carrying out the "legal physical examination" service project for harmonious labor relations, and then this practice was highly affirmed by the Municipal Federation and promoted throughout the city.

According to the industry agglomeration and the distribution of the workforce in Jiading District, the Jiading District Federation of Trade Unions relies on the resources of the District Employee Legal Aid Lawyer Volunteer Group to help enterprises find and sort out the employment legal risks existing in human resource management, deeply analyze the crimping causes, put forward reasonable suggestions from a professional perspective, and form the "Labor Relations Employment Assessment Report". Through the professional and reliable conclusion of the trade union, the enterprise optimizes its own management model, updates the employment endorsement law, and better clarifies the legal relationship with employees, avoids blind spots and loopholes in management, and prevents legal risks.

"The lawyer of the District Federation of Trade Unions has visited us many times, and the problem of how to implement the collective bargaining system that has plagued our company for a long time has finally been solved! Thanks to the District Federation, we are most qualified to praise the 'legal physical examination'!" The relevant person in charge of a plastic limited company in Jiading once revealed.

This year, the Jiading District Federation of Trade Unions continued to provide "legal physical examination" services for more than 30 enterprises, with a total of 46 door-to-door guidance, involving a total of 6,942 employees, issuing more than 30 corresponding legal physical examination reports, and finding a total of 281 hidden risks in enterprise labor relations, and giving 348 rectification suggestions. According to statistics, 200 rectification suggestions have been accepted and completed by enterprises. Through door-to-door guidance, consulting the labor contract, rules and regulations, and employee handbook, we can find problems and hidden dangers in personnel recruitment, labor contract, social insurance, working hours, overtime wages, rules and regulations, etc., and successfully help enterprises rectify and avoid the risk of employment problems, and ensure the implementation of the legitimate rights and interests of employees.

"Legal physical examination" is like "curing the disease", which is a "good medicine" to prevent or even eliminate labor conflicts from the source and build harmonious labor relations in enterprises, and it is also a "sharp weapon" for trade union organizations to effectively safeguard the legitimate rights and interests of employees, optimize the business environment, and participate in promoting the whole society to respect the law, learn the law, abide by the law, and use the law.

Assemble into a book, and use more practical measures to serve enterprises and employees

Through years of legal physical examination, a large number of cases and data from the front line have been accumulated, and finally, with the joint efforts of grassroots trade unions, workers, experts and scholars in Jiading District, they have been assembled into a book, and the "White Paper on "Legal Physical Examination" of Harmonious Labor Relations has been officially published.

In the white paper, 115 enterprises and institutions were summarized, 1,606 hidden risks of labor relations were investigated around 11 categories and 109 assessment items, and 1,174 rectification opinions were given, each of which was a "dry goods" obtained from practice. The white paper is becoming a "legal reference book" for Jiading enterprises to standardize employment behavior, protect the legitimate rights and interests of employees, and prevent labor conflicts at the source.

Spreading out the White Paper on "Legal Physical Examination" of Harmonious Labor Relations, the six chapters not only cover the implementation, overall situation, questionnaire survey, etc. of the "Legal Physical Examination" of Harmonious Labor Relations, but also some successful cases and related documents of "Legal Physical Examination" compiled internally have become the hot "standard answers".

"Trade unions should earnestly increase the intensity of rights protection + services, take more practical measures to do a good job of 'making the workers warm their hearts and feel at ease', and raise new heights in fulfilling the basic responsibilities of safeguarding the legitimate rights and interests of employees and serving the workers wholeheartedly. Lu Qiang, deputy director of the Standing Committee of the Jiading District People's Congress and chairman of the District Federation of Trade Unions, said.

The launch of the white paper on "Legal Physical Examination" reflects only one aspect of Jiading's deepening of the combination of rights protection and service. In addition, this year, the Federation of Trade Unions of Jiading District has also made outstanding achievements in the construction of the democratic management system of enterprises, the early warning and mediation of labor conflicts, the joint meeting of the government and the trade unions, the optimization and guidance of the construction of harmonious labor relations, and the publicity of the rule of law among employees.

In the future, the General Assembly of Jiading District will continue to learn and Xi implement the spirit of the 18th National Congress of the Chinese Trade Unions, promote the improvement of the labor union coordination labor relations system and promote the construction of the rights protection system for the all-round development of employees, actively build harmonious labor relations, realize, maintain and develop the fundamental interests of the workers, and be the most intimate family members of the employees.
