Tian Maoqing: There are two unique skills for the people to "untie relations".

Rule of Law Daily reporter Zhan Haifeng correspondent Bai Jie

"Jie(gi)Jiao" is a dialect of Xiushan Tujia and Miao Autonomous County in Chongqing, which means to mediate and deal with conflicts and disputes. Walking 22 kilometers northeast of Xiushan County, entering Longchi Town and coming to Longchi People's Court, the reporter of "Rule of Law Daily" walked into the "Laotian Settlement Room". The desk in the settlement room was full of files, a little messy, and an old man with gray temples was flipping through the case files that were about to be mediated. He is the old Tian in the mouth of the local people - Tian Maoqing, the resident mediator of the Longchi People's Court of the Xiushan County People's Court.

Lao Tian served as a soldier, and after transferring from the army in 1988, he chose to work in the Longchi Court of Xiushan Court, where he worked for 32 years. Because he is good at mediation, he has been commended by the Chongqing High People's Court as an outstanding judge guiding people's mediation work, a model of trial business in Chongqing and an expert in mediation. After retiring in 2020, Lao Tian continued to serve as a resident mediator, and in April this year, a special mediation studio was established - "Lao Tian Settlement Room".

They speak the truth that they understand

Qiu Shiqiu, president of the Longchi Court, told reporters that his long years of rural life and work experience have allowed Lao Tian to accumulate rich experience at the grassroots level, especially for mediation work, he has two sets of his own "unique skills": one is the "Seven Feelings Law", that is, to understand the social situation, to be familiar with the people's feelings, to analyze the facts of the case, to find out the facts, to move them with affection, supplemented by family affection, and to soothe the feelings; the second is to "look and hear and ask questions", that is, to make preliminary judgments with an observation attitude, listen to statements to find out the key to the problem, ask opinions to find out the mediation ideas, and develop a good solution to the crux of the problem.

Earlier this year, a young couple came to the Longchi court to sue for divorce, and both of them did not want the 4-year-old boy they had adopted together for various reasons.

"I don't have good economic conditions and can't afford to support my ......" "I have to go out to work, I can......'t manage it," the two argued fiercely.

Because it involves issues such as the guardianship and maintenance of minors, this case cannot simply deal with the contradiction of dissolution of marriage. The attitude of both spouses who refuse to raise the child is very clear, and if the child is forcibly awarded to either party for custody, it is not conducive to the child's growth. Considering these factors, the presiding judge transferred the case to the "Lao Tian Settlement Room" and asked Lao Tian to mediate.

After Lao Tian learned about the case, after some thought, he set off to the child's grandfather's house. Seeing Lao Tian coming, the child's grandfather came into the house and brought a stool, and the two sat in the courtyard and started a homework. Later, the old man called the child's parents and helped Lao Tian persuade the two.

Tian Maoqing (second from right) came to mediate the dispute.

"Since you have adopted this child, he is now the root of your family, and if you raise him young, he will be able to grow old with you in the future. Under Lao Tian's persuasion, the child's parents finally reached a divorce agreement, the child followed the father, and the mother compensated for the child support.

Because Lao Tian is very familiar with the local social conditions and people's feelings, and the child's grandfather is also an old acquaintance, when he first saw this case, he knew what was going on, and Lao Tian knew that the child's grandfather liked this little boy very much, and the grandfather and grandson had a deep relationship, so they would go straight to the child's grandfather's house and let him help mediate.

A black old blazer with a pair of liberation rubber shoes, walking on the country road in the wind and rain, he knew it in every village. When I walked into the people's homes, I found a bench to sit on and began to talk about family life and life, and then I started to talk about the case, saying the real things that the people could understand and understand. Yang Yinlei, the clerk of the "Lao Tian Settlement Room", talked about the scene when Lao Tian went to carry out mediation work.

Treat every case and everyone with care

Most of the disputes faced by the grassroots courts are trivial and short-term disputes between parents, but as far as rural people are concerned, it is often these small things that cause big trouble in their lives. Lao Tian was born and grew up in the countryside, and he can empathize with the rural people even more, and he treats every case and every party with care.

Not long ago, Mrs. Wang, who was nearly eighty years old, came to the court to sue her son Yang Qing, demanding that her deceased husband's death funeral allowance and insurance subsidy be divided of 3,740 yuan.

Tian Maoqing (middle) went to the rural courtyard to learn about the people's situation.

It was raining lightly, the sky was gray, and the air was a little dreary. In the intersectional room, Lao Tian comforted the mother and son, while observing the changes in the emotions and attitudes of the mother and son, and guided the two to say their hearts face to face.

"I don't want the money, I just want him to care about me more. Aunt Wang paused for a few seconds, choked up and said, "Since his father died, he didn't even say a word to me, I'm anyway, and I feel uncomfortable thinking about it." ”

"I'm not in good health and I don't have the ability to work, so you prefer you and ignore my difficulties, do you think I'm not uncomfortable?" Yang Qing couldn't help sobbing, because he was also in his 50s, and his life was under great pressure due to illness and financial difficulties.

Lao Tian gently patted Yang Qing's back with his hand, and guided both sides of their thoughts. In fact, Yang Qing did not want to take this subsidy for himself, but planned to use it to deal with the follow-up matters of his father's burial.

"When you two shake hands, I'm relieved. After untying the knot between the two sides, Lao Tian said. When the case was mediated, the rain outside had not stopped, Yang Qing held an umbrella and carefully helped Aunt Wang to leave the courtroom and go home together.

The upright person who was praised by the parties

"When dealing with the masses, if we encounter a problem, we often run to the 'Lao Tian Settlement Room' and drag Uncle Tian away. Zhang Hao, director of the Longchi Judicial Office, said, "We have set up a WeChat group with the court and the police station to facilitate the consultation of Uncle Tian and the exchange of information in the group." ”

The fame is getting bigger and bigger, and more and more people come to Lao Tian, not only the police stations, judicial offices, and grassroots mediation organizations in the jurisdiction of the Longchi Court, but also those in other jurisdictions. Lao Tian is busier than before, mediating more than 180 cases this year, with a mediation success rate of 98%.

"Lao Tian, you are an upright person, you said the accurate number. This is what many parties to the case say when they see Lao Tian, and it is also the highest praise of the local people for a person's reputation. This made Lao Tian quite relieved and proud.

In order to facilitate the people who are far away from the court, the Xiushan Court has successively set up the "Laotian Settlement Room" in 8 townships and towns in the jurisdiction of the Longchi Court, including Songnong, Yongdong and Daxi, and Laotian regularly conducts mediation work, giving face-to-face lectures to more than 120 mediators in various townships and villages, and striving to train more "Xiaotian" mediators to resolve more contradictions and disputes at the grassroots level and before litigation.

Lao Tian has a deep affection for the land and the people who live here, he often said: "It is not easy for the rural people, they have a weak sense of law, but they are very simple, as long as you treat people with courtesy, be kind and low-key, and reason with them patiently and sincerely, they will listen." ”

Rooted in the Longchi Court for more than 30 years, from the judge to the mediator, from the trial court to the "Lao Tian Settlement Room", Lao Tian uses his heart to convey the warmth of the mountains, one mouth skillfully solves conflicts and disputes, and two legs step out of one side of harmony. This was his initial choice, and it was his life's work. (Photo courtesy of Longchi People's Court of Xiushan County Court)
