In the third week of December 2023, which listed companies' environmental protection and disclosure responsibilities have lit up the red light?

Since September 2020, National Business Daily and the Institute of Public and Environmental Affairs (IPE), a well-known NGO in the field of environmental protection, have collected and analyzed the environmental information data of thousands of listed companies in China and tens of thousands of their subsidiaries (including branches, joint-stock companies and holding companies) every week based on authoritative data sources such as environmental quality, environmental emissions and pollution source supervision records issued by 31 provinces, municipalities and 337 prefecture-level municipal governments. The ability to disseminate information makes the environmental information in the business activities of listed companies in the capital market more transparent and transparent.

According to the data collected in the third week of December, the reporter of "Daily Economic News" found that a total of 13 listed companies have been exposed to environmental risks in the near future.

According to the data in this issue, risk information such as violations of laws and regulations in the field of ecological environment is related to 13 listed companies. Among them, 5 are state-owned controlled enterprises.

The reporter of "Daily Economic News" combed and found that there are 1.7606 million shareholders behind 13 listed companies, and the investment targets are on the environmental risk list, which may expose them to investment risks.

Among them, Sunway shares were administratively punished by the Taizhou Municipal Bureau of Ecology and Environment on November 30 for tampering with the monitoring data to meet the standards.

According to the penalty letter with the document number "Taihuan Penalty (2023) No. 12", when the automatic monitoring data of Sanwei Co., Ltd. is high, the staff squeezes the injection tube of the smoke and dust analyzer into a U-shape, so that the flue gas can filter out the smoke and dust through the water in the injection tube to reduce the concentration of smoke and dust, and achieve the false standard of the automatic monitoring data of smoke and dust, which belongs to Article 4, Item 8 of the "Measures for the Determination and Treatment of Fraudulent Behavior in Environmental Monitoring Data" (Huanfa [2015] No. 175), which has constituted tampering with the monitoring data. In accordance with Article 99, Paragraph 3 of the "Law of the People's Republic of China on the Prevention and Control of Air Pollution", he was fined 360,000 yuan by the Taizhou Municipal Bureau of Ecology and Environment.

On December 13, the reporter of "Daily Economic News" sent an interview letter through the public e-mail of Sanwei shares. On December 14, the reporter of "Daily Economic News" called Sanwei shares, and the operator said that he would go to check the interview letter.

In addition, Chengdu Capital Bangjie Environmental Protection Technology Co., Ltd., a holding company of Capital Environmental Protection, was fined 464,200 yuan by the Chengdu Municipal Bureau of Ecology and Environment for "discharging water pollutants exceeding the national or local water pollutant discharge standards", and the penalty number is "Chenghuan Penalty Zi [2023] QL044".

According to the administrative penalty decision, Chengdu Capital Bangjie Environmental Protection Technology Co., Ltd. submitted an application for a hearing after receiving the "Administrative Penalty Prior Notice" and the "Administrative Penalty Hearing Notice". The Chengdu Municipal Bureau of Ecology and Environment organized a public hearing on October 16, 2023. The Chengdu Municipal Bureau of Ecology and Environment believes that the hearing opinion submitted by the company does not affect the establishment of environmental violations.

Environmental penalties: Hazardous waste storage is not standardized, Yongtai Technology Holding Company was fined

The data included in this issue shows that Yongtai Technology (002326. SZ, share price of 11.37 yuan, market value of 10.389 billion yuan) holding subsidiary Chongqing Yongyuansheng Technology Co., Ltd., was fined 336,280 yuan by the Chongqing Fuling District Ecological Environment Bureau for "non-standard hazardous waste storage", the penalty number is "Fuhuan Penalty [2023] No. 22", and the penalty document is issued on December 7.

Lanzhou Yellow River (000929. SZ, share price 9.93 yuan, market value 1.845 billion yuan) Lanzhou Huanghe Jiazhu Beer Co., Ltd., a holding subsidiary, was fined 122,000 yuan by the Lanzhou Municipal Bureau of Ecology and Environment for "cleaning the secondary sedimentation tank of the sewage treatment station, taking out the sampling pump in the rectangular tank of the sewage discharge port without permission and putting it into a plastic bucket containing the water sample from the discharge port, resulting in the inability to monitor the wastewater discharged from the industrial wastewater discharge port of the unit during the cleaning of the secondary sedimentation tank", and the penalty number is "Lanhuan Penalty Zi [2023] No. 13".

On December 14, a reporter from the "Daily Economic News" called Lanzhou Huanghe, and the operator said that he would confirm the relevant situation of environmental penalties and check the interview letter. No further response was received by press time.

In addition, the cooperative city Jinling New Energy Co., Ltd. (hereinafter referred to as Jinling New Energy) was fined 138,900 yuan by the cooperative city natural resources bureau for "illegally using the grassland to build photovoltaic power generation projects without approval". Jinling New Energy is wholly owned by PowerChina New Energy Group Co., Ltd. (hereinafter referred to as PowerChina New Energy), a holding subsidiary of PowerChina and is planning to spin off and go public.

Credit China included a penalty letter with the document number "Hetian Zicao Penalty Zi [2023]", which shows that after inspection, it was found that the company illegally used 19.839 acres of grassland (including 18.5595 mu in Tawa Village, 0.5775 mu in Dirui Village, Duohe Village, and 0.588 mu in Jiala Village) on the natural grassland of Tawa Administrative Village, Nawu Town, Cooperative City, and Dirui Administrative Village, Zuogai Manma Town.

On November 1, the Ecology and Environment Bureau of the cooperative city issued a notice to Jinling New Energy ordering the correction of illegal acts. After investigation, Jinling New Energy admitted the illegal facts. At this point, the facts of the case are clear. The case was filed for investigation on November 15, and the investigation and evidence collection of the case was completed on November 28. On December 1, Jinling New Energy was fined 138,917 yuan by the Natural Resources Bureau of the cooperative city in accordance with Article 65 of the Grassland Law of the People's Republic of China.

In recent years, with the gradual rise of ESG (environmental, social responsibility and governance) investment philosophy, investors are paying more and more attention to the sustainable development ability of enterprises. Attention should also be paid to the environmental responsibility of listed companies' financial and strategic investments, so the environmental data of directly or indirectly participating companies are included in the A-share green reporting project database.

It should be noted that the disclosure of environmental information and data depends on the continuous improvement of the level of environmental regulatory information disclosure. From the 2008 Measures for Environmental Information Disclosure (Trial) to the newly revised Environmental Protection Law of the People's Republic of China, Chapter 5 of the Environmental Protection Law of the People's Republic of China establishes "information disclosure and public participation", information disclosure has been guaranteed from the establishment of the system.

Relevant laws and regulations stipulate that citizens, legal persons and other organizations have the right to obtain environmental information and participate in and supervise environmental protection in accordance with the law. The competent departments for environmental protection of people's governments at all levels and other departments responsible for the supervision and management of environmental protection shall disclose environmental information in accordance with law, improve procedures for public participation, and facilitate citizens, legal persons, and other organizations participating in and supervising environmental protection.

The 2018-2019 120 PITI Report on Regulatory Information Disclosure of Urban Pollution Sources (PITI) compiled by the Institute of Public and Environmental Affairs (IPE) and the Natural Resources Defense Council (NRDC) also pointed out that "disclosure is the norm and non-disclosure is the exception" has gradually become a recognized principle of the government and society.
