The CPC Central Committee and the State Council attach great importance to the construction of a strong country with intellectual property rights. General Secretary Xi Jinping made a series of important instructions and personally formulated the Outline for the Construction of an Intellectual Property Power (2021-2035), drawing a grand blueprint for the construction of an intellectual property power from six aspects, including the construction of an intellectual property system oriented to socialist modernization. On the afternoon of October 31, the State Council conducted the fourth special study with the theme of "In-depth Implementation of the Strategy of Building a Strong Country with Intellectual Property and Effectively Supporting Innovation-Driven Development", and Premier Li Qiang presided over the study and made an important speech, emphasizing the need to thoroughly study and implement the spirit of General Secretary Xi Jinping's important expositions and important instructions on intellectual property work, accelerate the construction of a strong country with intellectual property rights, and better serve the construction of a new development pattern and promote high-quality development. The draft amendments to the Implementing Rules of the Patent Law were deliberated by the executive meeting of the State Council. Patent examination policies and standards for new fields and new forms of business such as big data, artificial intelligence, and gene technology continue to improve. Second, the status of a major intellectual property country has been firmly established. As of September 2023, the number of valid invention patents and trademarks in mainland China reached 4.805 million and 45.122 million respectively, and the annual number of copyright registrations in 2022 reached 6.353 million. The number of PCT international patent applications has ranked first in the world for four consecutive years. Continental ranked 12th in the Global Innovation Index report released by the World Intellectual Property Organization, and for the first time ranked first in the world in terms of the number of top 100 scientific and technological innovation clusters in the world. Third, the transformation and application of intellectual property rights continue to be strengthened. The implementation of the intellectual property public service inclusive project has been launched, the electronic application rate of patents and trademarks has exceeded 99%, and the copyright registration of works and computer software has been handled online. Intellectual property public service institutions have achieved full coverage at the provincial level. The basic data of intellectual property rights should be "as open as possible". Sixth, international cooperation and exchanges on intellectual property rights have been deepened. Promote the establishment of the China Office of the World Intellectual Property Organization in China and the Shanghai Arbitration and Mediation Center, and cooperate in the construction of 101 Technology and Innovation Support Centers. The mainland is a big country in terms of data resources and digital economy, and the scale of the digital economy has reached 50.2 trillion yuan in 2022, accounting for 41.5% of GDP, ranking second in the world. In recent years, in accordance with the deployment requirements of the CPC Central Committee and the State Council, and under the overall planning of the National Development and Reform Commission, the State Intellectual Property Office has given full play to the functional advantages of the intellectual property department, actively carried out research and pilot work on data intellectual property protection rules, and achieved remarkable results.

First, the study proposes the basic principles of "four sufficiency" for constructing data intellectual property protection rules. Third, actively promote the pilot of local data intellectual property work. The Fourth Revision of the Patent Law has added relevant provisions that the patent administration department of the State Council can handle patent infringement disputes that have a significant impact on the whole country. In June 2021, the State Intellectual Property Office issued the Measures for Administrative Adjudication of Major Patent Infringement Disputes and the Announcement on Case Acceptance, officially launching the administrative adjudication of major patent infringement disputes. Up to now, the State Intellectual Property Office has accepted and concluded two batches of 12 administrative adjudication cases of major patent infringement disputes.
