Not long ago, on behalf of eight migrant workers, Zhu sought help from the Hongwei District People's Procuratorate because they were owed wages. In this case, the Hongwei District People's Procuratorate actively explored a new model of supporting prosecution, took the initiative to notify representatives of the employing unit and migrant workers to attend court, ascertained the facts, clarified the demands, and worked with the court case-handling personnel to explain the law and reason, and finally resolved the contradiction.
Helping vulnerable people like Zhu defend their rights is a microcosm of the civil support prosecution carried out by the procuratorial organs at the two levels in Liaoyang to "support" this group for their rights protection in accordance with the law.
In recent years, the procuratorial organs at both levels in Liaoyang City have taken support for prosecution as an important starting point for civil prosecution to actively integrate into the overall situation of work and practice justice for the people, breaking through the previous "sitting in court and waiting for cases" thinking, expanding case sources in multiple directions, supporting and assisting with multiple measures, and carrying out civil prosecution support prosecution work in a new model, helping socially disadvantaged groups quickly defend their rights and achieve good results.
As of July, the city's procuratorial organs had handled a total of 108 related cases, an increase of 36.9% over the same period last year, of which 102 courts adopted opinions in support of prosecution, an increase of 33.7% over the same period last year, and the amount involved in litigation reached 2.79 million yuan. The subjects involved include migrant workers, minors, the elderly, women and children without a means of subsistence, and persons with disabilities who have lost their ability to work.
By supporting the development of special activities for prosecution, procuratorial organs give full play to their supervisory functions, take active actions, take the initiative, use methods of supporting prosecution to quickly establish and handle cases, and form a joint force with court departments for filing and adjudicating cases, so that their lawful rights and interests are effectively safeguarded.
Aggressively expand the sources of leads
The civil procuratorial departments of the procuratorial organs at the two levels actively contacted the local public security, court, judicial, human resources and social security departments at the same level, grasped relevant clues as soon as possible, effectively expanded the source channels of cases, extended the tentacles of supporting prosecution work, and formed a multi-departmental interconnected interaction and close coordination of the "protection of vulnerable groups" work model, striving to achieve full support for prosecution cases. The Beacon Municipal People's Court actively visited the Legal Aid Center, the Labor Bureau, the Letters and Visits Bureau and other departments, and handled 69 cases of support for migrant workers' prosecutions, involving more than 1.6 million yuan.
Multiple initiatives to support vulnerable groups
In cases where the parties applying for support for prosecution are illiterate and find it difficult to seek help from others, the procuratorial organs fully respect the true wishes of the parties, actively assist the parties in writing litigation documents, and conscientiously act as "scriveners". For cases where parties are unable to investigate and collect evidence on their own due to objective reasons such as file management, state secrets, and commercial secrets, and have not yet endangered the public interest, make full use of the right of investigation and verification in accordance with the exhaustive element and act according to the application, and properly complete the work of assisting in the investigation and collection of evidence. For cases that are determined to support prosecution, promptly draft and issue a letter of support to the court, detailing the reasons for support, the facts of the case ascertained, and relevant legal application opinions, to ensure that the case is concluded as soon as possible.
