Recently, the creation of the "Cowherd and Weaver Girl" sculpture in Lushan County, Henan Province has attracted attention, and the person in charge of the Construction Bureau and related personnel have been dealt with. However, from the bidding process of this project, there are three questions to be solved:
1. Is it a rule to cancel the public announcement period of project bidding and evaluation results?
According to public information, the project issued a bidding announcement on June 14, 2023, opened the bid on July 6, and issued the winning bid announcement on the same day. The winning bid amount was 7.152 million yuan, and the winning enterprise was Ruize Art (Shenzhen) Co., Ltd.
According to Article 54 of the Regulations for the Implementation of the Law of the People's Republic of China on Tendering and Bidding, that is, for projects that must be tendered according to law, the tenderer shall publicize the winning candidate within 3 days from the date of receiving the bid evaluation report, and the publicity period shall not be less than 3 days.
Is it suspected of violating laws and regulations to publish the winning bid result without publicizing the bid evaluation result? Why are tenderers so impatient to cancel the three-day publicity period?
2. If the project bidding has not been completed and the construction of the sculpture has begun, is it suspected of being built before it is recruited and not being decided?
The project issued a tender announcement on June 14, 2023, but a week later, on June 23, a video was posted saying that the base of the sculpture had been built.
3. If the winning unit has repeatedly won the bid, is it suspected of bid-rigging? Is it suspected of monopoly?
The winning enterprise of this project, Ruize Art Shenzhen Co., Ltd., was established in 2011 and has a registered address in Longgang District, Shenzhen. Previously, the company name was Shenzhen Guodi Landscape Art Co., Ltd. The winning information available is as follows:
On September 27, 2019, the bid for the Lushan Cultural and Tourism Bureau for the Lushan Iron Smelting Scene Sculpture Project won the bid amount of 1.6212 million yuan.
In March 2021, it won the bid for the Shahe landscape sculpture in Lushan County of Lushan County Housing and Construction Bureau (Mozi, Cangjie, Yuandexiu cast bronze sculpture), with a bid amount of 900,000 yuan.
In August 2018, Shenzhen Guodi Landscape Art Co., Ltd. won the bid for the "Cheng Hao" sculpture, "Cheng Hao lecture" sculpture and "Ru porcelain firing scene reproduction" sculpture projects of Baofeng County Transportation Bureau, with a contract amount of 4.238 million yuan.
Lushan County and Baofeng County are under the jurisdiction of Pingdingshan City.
