Adopted at the Second Meeting of the Standing Committee of the Ninth National People's Congress on April 29, 1998

Fire Protection Law - main content

The main contents of the text are general principles, fire prevention, fire organization, fire fighting and rescue, supervision and inspection, legal liability, and supplementary provisions.

1. The purpose of the legislation

In order to prevent fires and reduce fire hazards, strengthen emergency rescue work, protect personal and property safety, and maintain public safety.

2. Working principles

In accordance with the principles of unified leadership of the government, supervision by departments according to law, overall responsibility of units and active participation of citizens, the fire safety responsibility system is implemented, and a socialized fire protection work network is established and improved.

3. Civic duty

All units and individuals have the obligation to maintain fire safety, protect fire protection facilities, prevent fires, and report fire alarms. All units and adults have the obligation to participate in organized fire fighting work.

4. National orientation

The State encourages and supports fire science research and technological innovation, and promotes the use of advanced fire protection and emergency rescue technologies and equipment; Encourage and support social forces to carry out fire protection public welfare activities.

5. Fire prevention

The fire protection design and construction of construction projects must comply with the national technical standards for fire protection in engineering construction. Construction, design, construction, project supervision and other units shall be responsible for the fire protection design and construction quality of construction projects in accordance with law. The specific measures for fire protection design review, fire control acceptance, filing and spot check of construction projects shall be formulated by the competent department of housing and urban-rural construction under the State Council. Organs, organizations, enterprises, institutions and other units shall perform their respective fire safety duties. Fire protection products must meet national standards; If there is no national standard, it must comply with the industry standard. It is forbidden to produce, sell or use unqualified fire protection products and fire protection products that have been eliminated by the state.

6. Fire fighting and rescue

Anyone who discovers a fire should immediately report to the police. All units and individuals shall facilitate the reporting of the police free of charge, and must not obstruct the alarm. It is strictly forbidden to lie about the fire alarm. In the event of a fire in a crowded place, the on-site staff of the place shall immediately organize and guide the evacuation of the personnel present. In the event of a fire in any unit, it is necessary to immediately organize forces to put it out. Neighboring units should provide support. When the fire brigade receives the fire alarm, it must immediately rush to the scene of the fire to rescue the people in distress, eliminate the dangerous situation, and extinguish the fire.

7. Supervision and inspection

If the fire rescue agency discovers a fire hazard during the fire supervision and inspection, it shall notify the relevant unit or individual to immediately take measures to eliminate the hidden danger; Where failure to eliminate hidden dangers in a timely manner may seriously threaten public safety, fire rescue agencies shall take temporary sealing measures for dangerous parts or places in accordance with provisions.

8. Legal liability

The administrative punishments provided for in this Law shall be decided by the public security organs in accordance with the relevant provisions of the "Law of the People's Republic of China on Administrative Punishments for Public Security", and by the competent departments of housing and urban-rural construction and fire rescue agencies in accordance with their respective functions and powers. Where a person is ordered to stop construction, use, production or business, he shall report to the department or agency that made the decision after rectification, and only after passing the inspection can the construction, use, production and operation be resumed. Where the parties fail to implement the decision to suspend production, business, use, or construction within the time limit, the department or agency that made the decision shall enforce it.

9. Definition of place

Public gathering places refer to hotels, restaurants, shopping malls, bazaars, waiting rooms of passenger stations, waiting halls of passenger terminals, civil airport terminals, stadiums, halls and public entertainment places.

Crowded places refer to public gathering places, outpatient buildings and ward buildings of hospitals, teaching buildings, libraries, canteens and collective dormitories of schools, nursing homes, welfare homes, nurseries, kindergartens, reading rooms of public libraries, exhibition halls of public exhibition halls and museums, production and processing workshops and employee dormitories of labor-intensive enterprises, tourism and religious activity sites, etc.
