On the morning of June 9, the village committee square of Changle Village, Miaoba Town, Dazhu County, was crowded, and the circuit trial of an illegal hunting case in the Dazhu Court began with a crisp sound of the gavel. Deng stood in the dock on suspicion of illegal hunting, and more than 1,000 people, including cadres of the town's village, the masses, and local primary school students, attended the trial.
The defendant Deng Moumou had the idea of using hunting traps to hunt wild animals because wild animals frequently haunted his cultivated land, destroying crops and affecting harvests. In March 2022, Deng Moumou purchased 3 sets of hunting bags in a town street in Dazhu County, and without obtaining a hunting license, placed one of the hunting traps (seized) in his cultivated land in April of the same year, captured a "deaf pig" (scientific name Xiaoji) in May, and captured a civet and a pheasant (scientific name pheasant) in November of the same year. Some of the captured "deaf pigs" were eaten by their families, and the rest were stored in their refrigerators, along with civets and pheasants, and later seized by the Dazhu County public security organs.
According to the Sichuan Chuanfa Environmental Damage Judicial Appraisal Institute, the seized wild animals are terrestrial wild animals with important ecological, scientific and social value, with a value ranging from 300 yuan per animal to 3,000 yuan per animal.
After trial, the Dazhu Court held that the defendant Deng Moumou violated hunting laws and regulations by using prohibited methods in the game reserve and hunting ban period, destroying wildlife resources, and the circumstances were serious, and his behavior constituted the crime of illegal hunting. Deng Moumou's truthful confession of his crime after arriving at the case is a confession and can be given a lighter punishment. Deng Moumou admitted guilt and accepted punishment, and can be treated leniently. Deng's personal property and unlawful gains used in crimes shall be confiscated in accordance with law.
The Dazhu Court pronounced the verdict on the spot: sentenced the defendant Deng Moumou to four months' detention and four months' probation for the crime of illegal hunting; The seizure of articles and animal remains shall be handled by the seizing authority in accordance with law.
After the trial, the magistrate conducted legal education to the audience from Xi Jinping Thought on Ecological Civilization, Criminal Law on Environmental Resources, and Biodiversity Protection, fully explained the law and reasoning, explained typical cases of crimes that destroyed ecological environment and resources, and used this circuit trial as a starting point to carry out publicity on legal knowledge such as criminal law, wildlife protection law, anti-narcotics, and anti-fraud, patiently answered the legal questions raised by the masses at the scene, and sent a lesson on the rule of law that was "full of dry goods".
