However, there are still people who take chances and take risks, buy tickets through "scalpers", and circumvent the height restriction order.
On the afternoon of June 6, 2023, the judge undertaking the Jiangyin Municipal People's Court received a relevant text message showing that the executed person Zhou arrived at Wuxi Shuofang Airport at 7 p.m. by plane. Upon inquiry, Zhou has been taken measures to restrict consumption in accordance with the law and included in the list of untrustworthy persons subject to enforcement, and his behavior of taking the plane obviously violated the height restriction order.
In order to control the executed person in time, the executive police of the Jiangyin Court acted quickly and went to Wuxi Shuofang Airport. At 7:26 p.m., the executor Zhou was controlled at Shuofang Airport, and after investigation, Zhou purchased a ticket to travel to Vietnam through a "scalper". The enforcement judge informed Zhou on the spot that his behavior violated Article 3 of the Several Provisions of the Supreme People's Court on Restricting High Consumption and Related Consumption of the Defendant: If the defendant is a natural person, after being taken measures to restrict consumption, he shall not have the following high-consumption and consumption behaviors that are not necessary for life and work: (1) When taking transportation, choose a second-class or higher cabin on an airplane, train, or ship... The defendant Zhou realized his mistake and wrote a "letter of remorse", promising that there would be no further violations of the restriction on high consumption in the future, and if there was an emergency, he would report to the court in time.
Repentance
Zhou's behavior obviously violated the height limit order, and combined with the behavior and performance of the defendant Zhou, the Jiangyin court decided to take the compulsory measure of judicial detention for 15 days against the defendant Zhou.
Consumption in violation of the height restriction order is an act of refusing to perform on a judgment or ruling of the people's court that has already taken legal effect, and the court will detain and fine it in accordance with Article 114 of the Civil Procedure Law of the People's Republic of China; Where the circumstances are serious and constitute a crime, criminal responsibility shall be pursued in accordance with law. The Jiangyin court will continue to implement the spirit of the Supreme People's Court's Notice on Carrying out Special Rectification Actions against Enforcement Persons Violating the Height Limit Order, carry out special rectification actions against persons subject to enforcement who take flights in violation of the height limit order, and plug illegal loopholes.
