1 What are Chinese medicinal herbs?
The Measures for the Supervision and Administration of the Quarantine of Chinese Medicinal Materials Entering and Leaving China sets out customs supervision requirements for plant-derived Chinese medicinal materials and animal-derived Chinese medicinal materials. The above two types of Chinese medicinal materials refer to the medicinal parts of medicinal plants and animals, and the raw materials formed by primary processing after harvesting.
China's imports of Chinese medicinal materials are mainly domestic scarce and precious varieties.
2 Quarantine access
■
The General Administration of Customs implements a quarantine access system for imported Chinese medicinal materials, including product risk analysis, regulatory system assessment and review, determination of quarantine requirements, registration of overseas production enterprises, and entry quarantine. At present, the mainland has approved hundreds of kinds of Chinese medicinal materials from 91 countries and regions, and enterprises can inquire about the types of Chinese medicinal materials approved for import and the directory of exporting countries and regions at the General Administration of Customs - Department of Animal and Plant Quarantine - Quarantine Requirements and Warning Information (http://dzs.customs.gov.cn/dzs/2746776/4445554/index.html).
■Imported animal-derived Chinese medicinal materials and some plant-derived Chinese medicinal materials need to apply for quarantine approval in advance, and enterprises should apply to the customs for the "Quarantine License for Animals and Plants Entering China" before signing the trade contract.
3 Declaration of entry
Cargo owners of imported Chinese medicinal materials or their agents should complete customs declaration procedures at the port of entry or arrival customs with the following materials before or during the entry of Chinese medicinal materials:
■ Quarantine certificate issued by the official of the exporting country or region that meets the requirements of the General Administration of Customs;
■ Certificate of origin, trade contract, bill of lading, packing list, invoice.
The Customs shall review the relevant documents submitted by the cargo owner or its agent, and accept the application for inspection if it meets the requirements.
If there is no valid quarantine certificate issued by the animal and plant quarantine authority of the government of the exporting country or region, and registration is not required and registration is not carried out as required, or quarantine examination and approval procedures are not completed according to law, the Customs may return or destroy it according to the specific circumstances.
4 On-site quarantine
The customs at the port of import shall carry out on-site inspection of imported medicinal materials in accordance with the system instructions, and conduct conformity assessment according to the consistency of the cargo certificate, packaging and bedding materials, whether the medicinal materials are corrupted and deteriorated, whether they carry harmful organisms, and whether they carry prohibited substances.
5 Qualified release
Imported Chinese medicinal materials can only be sold, used or stored or processed in designated enterprises after passing the quarantine and quarantine of imported goods.
If the quarantine is unqualified, the Customs shall issue a quarantine treatment notice, and the cargo owner or its agent shall remove, return or destroy the harm under the supervision of the Customs, and shall be allowed to enter the country after the pest elimination treatment is qualified.
