Because of their convenience and speed, shared bicycles, electric bicycles and tricycles have become the main means of transportation for many residents to travel or carry goods. However, the safety awareness of some electric vehicle drivers is weak, resulting in an increase in traffic accidents, which seriously affects road traffic safety and the image of a civilized city. In response to this situation, on September 2, the People's Procuratorate of Xifeng County organized a public hearing on public interest litigation cases involving traffic safety hazards such as sharing electric bicycles and unlicensed tricycles on the road in the county.

In addition to the traffic police brigade of the Xifeng County Public Security Bureau, the Market Supervision and Administration Bureau of Xifeng County, the Industry and Information Technology Bureau of Xifeng County, and the Bureau of Commerce of Xifeng County, all of whom were present for the hearing, deputies to the people's congress and lawyers also attended the hearing.

According to data provided by the Traffic Police Brigade of the Xifeng County Public Security Bureau, the county currently has 39,000 two- and three-wheeled motorcycles. Since 2020, a total of 7,342 illegal acts of electric bicycles and two- and three-wheeled motorcycles have been investigated and punished, and 462 minors under the age of 16 have been persuaded and educated to ride vehicles.

At present, there are two main problems, one is that the shared electric bicycle is not implemented in accordance with the law to implement the registration management on the road, and there are minors under the age of 16 riding in violation of the law; secondly, the tricycle driver uses the tricycle for pulling goods, carrying people, mixing people and goods, and transporting couriers without registering according to law.

At the hearing, representatives of administrative functional departments gave a defense explanation on the safety of electric vehicles, performance obligations, previous performance of duties and next steps. The hearing officer asked the functional departments how to solve the problems raised by the procuratorate and gave reasonable suggestions.

Representatives and hearings agreed during the discussion that effective governance can only be achieved if multiple sectors work together. First, before entering the market, effectively control the sales access conditions, and at the same time strengthen the targeted publicity of the list of products related to the registration of motor vehicles to improve the safety awareness of the masses; the second is to implement registration management for vehicles that meet the registration according to law, and take a certain way to clearly identify and control existing vehicles that do not meet the registration standards; the third is to coordinate the insurance management department to standardize the vehicle insurance system and include shared electric vehicles and tricycles in the insurance scope; the fourth is to increase the publicity of road traffic safety. Give full play to the role of township and community counselors, check and compile records of the masses' purchase of electric vehicles and tricycles, and include them in the traffic management cloud platform for standardized management.

This hearing is the first public hearing involving public interest litigation and other fields carried out by the People's Procuratorate since the implementation of the Rules for handling public interest litigation of the People's Procuratorate, and it is also the first public hearing on public interest litigation cases involving electric vehicles in Guiyang City, which realizes the openness and transparency of the handling process of public interest litigation cases and ensures that the procuratorial power always runs under the sun.
