The demolition compensation plan for the Shiqi road came out

Last night, the municipal government announced the expropriation compensation plan for the Shiqi section of the Qijiang Road Project.

Judging from the schematic map of the project scope announced, the compensation plan is aimed at the scope from the junction of Qingxi Road and Lianyuan West Road to the south to the Baishi Yongkou of Anlan Road and Huaguang Road.

Expropriation and compensation scheme for houses on state-owned land

Due to the construction of the Qijiang Road Project (East Bank - Guangzhou-Macao Expressway to Hengfa Street), it is necessary to expropriate some state-owned land and houses in Qingxi Road, Fengming Road, Nanji Road, Minquan Road, Anlan Road, Huaguang Road and other sections of Shiqi Street in Zhongshan City. In accordance with the Provisions of the People's Republic of China on land management, the Regulations on the Expropriation and Compensation of Houses on State-Owned Land, the Measures for the Assessment of Housing Expropriation on State-Owned Land, the Notice on the Measures for the Expropriation and Compensation of Houses on State-owned Land in Zhongshan City (Zhongfu [2013] No. 141), the Implementation Opinions of the Zhongshan Municipal People's Government on the Expropriation and Compensation of Land for Public Welfare Projects in Zhongshan City (Zhongfu [2019] No. 107), etc., combined with the actual situation of land and housing within the scope of this project, this overall compensation plan is formulated.

1. Scope of expropriation

For land and houses within the red line of the construction of Qijiang Road, the scope of expropriation shall ultimately be subject to the red line map of project expropriation determined by the Municipal Construction Project Management Office.

2. Objects and methods of expropriation compensation

(1) All the legal rights holders of real estate that are included in the red line of this expropriation are the objects of expropriation compensation, and the expropriated person shall use the legal "Land Use Right Certificate", "House Ownership Certificate", "Real Estate Property Rights Certificate" or the ownership certificate materials issued by the relevant departments to investigate and determine as the basis for compensation.

(2) The expropriated person may choose monetary compensation or compensation for the exchange of housing property rights.

(3) The real estate ownership certificate held by the owner of the real estate right shall be used as the unit of calculation for the number of households (if more than one co-ownership certificate is issued at the same time as a real estate, it is still calculated as one household).

3. Details of compensation for expropriation

(1) Compensation for expropriation of houses on state-owned land.

1. The amount of compensation for the expropriated real estate shall be based on the results of the real estate appraisal issued by the appraisal institution with the corresponding qualifications.

2. Adopt the method of compensation for the exchange of property rights of the house, settle the difference between the value of the expropriated house and the value of the house used for property rights exchange with the expropriated person, and the value of the expropriated house and the value of the house used for property rights exchange are based on the real estate appraisal results issued by the appraisal agency with corresponding qualifications.

(2) Levying housing fees for the temporary resettlement of residents' residences.

1. The temporary resettlement residence fee is paid according to the standard of the real estate area of the levied house multiplied by the average rent of Shiqi Street of 22 yuan / square meter, and each household is not less than 1800 yuan / month. Temporary placement of housing fees one-time compensation for 18 months, the expropriated person solves the swing space excess by himself.

2. For expropriated persons from poor families such as minimum guarantee and disability confirmed by the civil affairs department, the temporary resettlement fee shall be increased by 30% in accordance with the prescribed standards and compensated.

(3) Compensation for decoration and decoration shall be carried out in conjunction with the assessment report issued by an assessment institution with corresponding qualifications.

(4) Levy of residential moving fees.

One-time compensation for the expropriated person 10,000 yuan / household moving fee (including water, electricity, telecommunications, etc.). For expropriated persons from poor families such as minimum guarantee and disability confirmed by the civil affairs department, the moving fee shall be compensated to the expropriated person at a one-time rate of 13,000 yuan per household (including water, electricity, telecommunications, etc.).

(5) Where the suspension of production and business is suspended due to the expropriation of land and housing, compensation shall be made for compensation expenses such as the relocation of attachments and assets on the ground, the loss of suspension of production and business, and the severance pay of workers with legal business procedures, combined with the assessment report issued by an appraisal institution with corresponding qualifications. The compensation period for suspension of production and business suspension is 6 months.

(6) Other matters.

1. There is no compensation for the land occupied by the red line of the project land that has been planned for construction or outside the red line of the construction of the construction or the project.

2. The red line of the project land occupies the land that has not yet gone through the planning and construction procedures, and the scope of occupation is determined in the following order of compensation, of which industrial land (except for new industrial land, commodity plant land) and storage land are compensated in monetary terms according to point (3).

(1) Compensation for the construction area of the same parcel.

(2) Off-site compensation for the measured floor area.

(3) Monetary compensation.

3. There are above-ground attachments on state-owned construction land, and the compensation for above-ground attachments is implemented in accordance with Zhongfu [2019] No. 107 document, which does not explicitly implement compensation according to the assessment report issued by an assessment institution with corresponding qualifications.

Fourth, the incentive mechanism

(1) Signing contracts and delivering rewards within a limited period of time.

1. Where the registered land use right is signed before May 25, 2022, and the written transfer of land and housing is completed within the time specified in the agreement, the house with land use as residential or commercial residential shall be rewarded according to 20% of the total assessed value of the land expropriated and the land use shall be rewarded according to 10% of the total assessed value of the expropriated land and house for the house other than residential or commercial residence.

2. Where the land is vacant, there is no reward.

(2) Housing subsidies.

1. In order to ensure the living conditions of the expropriated person, if the ownership of the house is registered in the name of an individual and the land is registered as a residential or commercial residence, a housing subsidy of 6500 yuan / square meter will be given.

For residential houses that have not been registered but are identified by the Shiqi Street Historical Land and Housing Joint Review Team as individuals living in, a subsidy of 5525 yuan / square meter will be given to the part where the housing area meets the corresponding planning conditions; the part that exceeds the planning conditions will not be subsidized.

2. There is no subsidy for the current status of the land as vacant land.

(3) If the compensation for the same parcel capacity construction area or the compensation for the capacity building area of the same parcel is applied to the land with the compensation of the capacity building area in different places, the above incentive mechanism shall not apply.

5. Other matters

(1) Other compensation items not mentioned above shall be implemented in accordance with the relevant provisions of Zhongfu [2013] No. 141 document and Zhongfu [2019] No. 107 document.

(2) Where upon investigation it is determined that it is an illegal building, a temporary building that has exceeded the approval period, or illegal land use, no compensation shall be given and shall be dealt with in accordance with regulations.

(3) The matters not covered by this plan shall be resolved through consultation between the two parties to the expropriation, and if the consultation fails, it shall be implemented in accordance with the relevant laws and regulations of the State and relevant policies.

(4) This plan only applies to the compensation for land and housing expropriation implemented within the Shiqi Street area of the Qijiang Road Project (East Bank - Guangzhou-Macao Expressway to Hengfa Street).

(5) This plan is organized and implemented by the Shiqi Subdistrict Office of Zhongshan Municipal People's Government.
