Brief facts of the case
The garment factory operated by Zhu Mou owed 45 workers a total of 183,681.21 yuan in wages and did not pay them, and 45 workers complained to the county human resources and social security bureau. After investigation, the county human resources and social security bureau found that it was true, issued relevant documents to Zhu on many occasions, and delivered them through various means such as posting notices and sms notices, ordering him to pay the wages owed by migrant workers within a specified period of time. After receiving the transfer from the human resources and social security department, the Yudu police immediately filed a case for investigation and pursued Zhu Mou on the Internet. After hard work, the Yudu police arrested Zhu's hometown of Xinfeng County. After Zhu arrived at the case, he still had luck, not to find a way to pay the arrears of wages, but to deny it in every way, but in the face of a large amount of evidence, Zhu finally confessed to the law.
A few days ago, Zhu was sentenced to one year and six months in prison and fined 20,000 yuan for the crime of refusing to pay labor remuneration. At the same time, the court ordered the court to continue to pay the labor remuneration of each worker totaling RMB183,681.21.
As early as 2011, the Criminal Law Amendment (VIII) incorporated the crime of "refusing to pay labor remuneration" into the criminal law. Article 41 provides:
Whoever evades the payment of the worker's labor remuneration by means of transferring property, hiding, or so on, or who has the ability to pay the labor remuneration but does not pay the labor remuneration, if the amount is relatively large, and is ordered to pay by the relevant government departments, but still fails to pay, shall be sentenced to fixed-term imprisonment of not more than three years or criminal detention, and shall also be fined or fined alone;
Where a unit commits the crime of arrears, it shall be fined, and the persons who are directly in charge and the other persons who are directly responsible for it shall be punished in accordance with the provisions of the preceding paragraph.
