Last spring, when Liu Yue handled Zhang's theft case, at the beginning of the acceptance, she originally felt that this was a very simple theft case, but when she learned the story behind Zhang, she felt that she needed to do a lot of work. Zhang Mou, because of a momentary greed, stole a total of more than 28,000 yuan from his two neighbors by using mobile phone Alipay and WeChat scanning codes. At that time, although Zhang was in his early 20s, he was already a mother of two young children, and the only source of income in the family was to rely on her husband to do odd jobs, and their lives were very poor. Although Zhang's theft should be punished by law, as long as he thinks that two young children will lose their mothers, a complete family is on the verge of fragmentation. Liu Yue decided to work harder to save this runaway family, and after many consultations and mediation, Zhang signed a compensation agreement and a repayment plan with the two victims, and finally obtained the understanding of the two victims. Through social investigation and evaluation, the court ruled that Zhang's sentence enforcement method should be suspended, which gave her the opportunity to make up for the mistakes she had made, and also allowed the two young children not to lose their mothers in childhood.
Caring for the healthy growth of minors is the focus of national and social attention, and it is also the unshirkable responsibility of a procurator who has not been prosecuted. As an unprosecuted procurator, Comrade Liu Yue is worried about the growth and future of every juvenile involved in crimes, and tries to achieve the organic unity of legal and social effects in handling cases.
In a juvenile intentional injury case last year, 16-year-old Zhang Mou (pseudonym) had a dispute with his classmate Wang Mou (pseudonym) over a trivial matter, and in the process of fighting, Zhang Mou caused Wang Mou's spleen to rupture, causing second-degree serious injury, and Zhang was transferred by the public security organs for examination and prosecution on suspicion of intentional injury. In this special case, Liu Yue is facing a more difficult choice, on the one hand, Zhang has reached the age of criminal responsibility, and his behavior should be punished by the law; on the other hand, Zhang is studying in the third year of junior high school, and he is about to face the first important stage in his life - the middle school entrance examination. Throughout the case-handling stage, what constantly emerged in Liu Yue's mind was Zhang Moushang's childish face and tears of remorse. In order to save the child's future, she adhered to the judicial concept of "education as the mainstay, punishment as a supplement", carried out a social investigation of Zhang, after several case discussions and mediation, the two sides reached a settlement agreement, after soliciting the opinions of the victims, education, justice and other departments, and finally made a conditional decision not to prosecute the minor Zhang in accordance with the law, so that Zhang had the opportunity to return to school and complete his studies.
Tired and gained, busy and progressive, youth will not fail everyone with a heart, and the perseverance will eventually be full of harvest.
