The reporter learned from the Traffic Management Bureau of the Ministry of Public Security that the "Road Traffic Safety Law" implemented in 2004 stipulates a traffic violation scoring system, and in the same year, the Ministry of Public Security issued the "Regulations on the Application and Use of Motor Vehicle Driving Licenses", which clarified the scoring behavior and scoring value in the form of an annex. The main purpose of the separate formulation of the new departmental regulations "Measures for the Scoring and Management of Road Traffic Safety Violations" is to better play the role of the scoring system, adhere to the combination of leniency and severity, strengthen education and guidance, and promote the improvement of drivers' awareness of safety and civilization.

After the revision, the items that are scored 9 points at one time have been added, and the items that are scored 2 points at a time have been deleted. After the modification, there are 50 scoring behaviors, of which 7 are worth 12 points, 7 are worth 9 points, 11 are scored 6 points, 15 are scored 3 points, and 10 items are scored 1 point.

The new scoring management measures continue to maintain 12 points for violations that seriously obstruct traffic safety, such as drunk driving, fleeing after causing casualties in traffic accidents, and using forged and altered license plates.

According to the degree of impact on road traffic safety and smoothness, the demerit point value of some traffic violations is reduced. Driving a vehicle that does not conform to the license plate is reduced from 12 points to 9 points; the score for driving a motor vehicle that does not hang a number plate or deliberately obscures or defacess the number plate is adjusted from 12 points to 9 points; the illegal score for driving a motor vehicle that does not install a number plate in accordance with the regulations is the largest drop, from the original 12 points to 3 points; and the driving violation of the prohibition sign and the prohibition marking instruction is adjusted from the original 3 points to 1 point.

Some traffic violations have increased their scores, and the number of points for obstructing safe driving such as driving with a mobile phone has been increased from 2 points to 3 points; when the road congestion is slowed down, 3 points are deducted for illegal traffic, such as congestion and occupying the opposite lane; illegal parking on high-speed or urban expressways has increased from 6 points to 9 points.

Some minor traffic violations are not scored, such as driving without placing inspection signs and insurance signs, and not carrying driving licenses and driver's licenses with them.

In addition, some scoring items have been added, 12 points are credited for selling driver's licenses for profit, 12 points are deducted for reversing, retrograde, or crossing the central divider belt on urban expressways, and 1 point is deducted for driving a truck that has changed the registered structure, structure or characteristics without authorization.

Scores below 12 points can be deducted by learning the method to "return blood"

The scoring management method adds a provision of "deducting points from studying the law", and drivers can "return blood" through this method. The reporter learned that as early as September 2020, the "learning the law and subtracting points" system in Hunan Province was all put into operation.

Drivers with less than 12 points on the driver's license who meet the conditions and apply, participate in the study of road traffic safety laws, regulations and related knowledge and pass the examination, or participate in the traffic safety public welfare activities organized by the public security traffic management department, can deduct points from the accumulated points, and can deduct up to 6 points in a scoring cycle. The deduction of points for studying the law can only be deducted from the driver's existing accumulated point value, with a cumulative maximum of 6 points, but may not be used to reduce or reduce the point value of traffic violations that have not yet occurred.

■ A motor vehicle driver who commits one of the following traffic violations is deducted 12 points at a time:

(1) Driving a motor vehicle after drinking alcohol;

(2) Fleeing after causing a traffic accident that causes minor injuries or death, and does not yet constitute a crime;

(3) Using forged or altered motor vehicle number plates, driving licenses, driver's licenses, or school bus signs, or using other motor vehicle number plates or driving licenses;

(7) Accepting penalties and demerit points for traffic violations in place of actual motor vehicle drivers for economic gain.

■ A motor vehicle driver who commits one of the following traffic violations is deducted 9 points at a time:

(1) Driving a passenger car with 7 or more seats carrying more than 50 percent of the approved number of passengers but not reaching 100 percent;

(2) Driving school buses, medium-sized or above passenger and cargo vehicles, or dangerous goods transport vehicles on roads other than highways or urban expressways that exceed the prescribed speed of 50 percent or more;

(3) Driving a motor vehicle to illegally stop on a highway or urban expressway;

(4) Driving a motor vehicle that does not hang a motor vehicle number plate or deliberately obscures or defaces the number plate of a motor vehicle on the road;

(5) Driving a motor vehicle that does not conform to the type of quasi-driving vehicle;

(6) Driving a school bus without obtaining a school bus driving qualification;

(7) Continuously driving medium-sized passenger cars or dangerous goods transport vehicles for more than 4 hours without stopping for a break or stopping for less than 20 minutes.

(2) Driving a motor vehicle that does not follow regulations, or does not reverse or make a U-turn on a road other than a highway or urban expressway;

(3) Driving a motor vehicle without using lights in accordance with regulations;

(4) Driving a motor vehicle in violation of prohibition signs or prohibition marking instructions;

(5) Driving a motor vehicle to carry cargo in length, width, or height exceeding the provisions;

(6) Driving a truck carrying goods that exceeds the maximum allowable total mass and does not reach 30 percent;

(7) Driving a motor vehicle other than a highway passenger car, a tourist passenger car, or a dangerous goods transport vehicle that has not carried out regular safety technical inspections in accordance with regulations on the road;

(8) Driving a truck carrying a truck that has changed the registered structure, structure or characteristics on the road without authorization;

(9) When driving a motor vehicle on the road, the driver of the motor vehicle fails to wear a seat belt in accordance with regulations;

(10) Driving a motorcycle without wearing a safety helmet.
