The State Intellectual Property Office issued a notice today (February 14) to crack down on malicious preemptive registration of trademarks such as "Ice Pier" and "Gu Ailing" in accordance with the law.
In accordance with the regulations on the protection of Olympic Symbols and the provisions of Article 10, Paragraph 1, Item (8) of the Trademark Law, the State Intellectual Property Office rejected 429 trademark registration applications, including No. 41128524 "Ice Pier" and No. 62453532 "Gu Ailing"; in accordance with the provisions of Article 44, Paragraph 1 of the Trademark Law, 43 41126916 registered trademarks such as "Snow Pier" and 38770198 "Gu Ailing" were declared invalid ex officio.
Since 2019, a small number of enterprises and natural persons, for the purpose of obtaining improper benefits, have maliciously preemptively registered hot words such as mascots and athletes of the Beijing 2022 Winter Olympic and Paralympic Games, entrusted agencies to submit trademark registration applications, illegally exploited the reputation of the Olympic Games and the Olympic Organizing Committee, infringed on the name rights of others and other legitimate rights and interests, caused major adverse social impacts, and damaged the mainland's good image of strict protection of intellectual property rights.
In March last year, unscrupulous enterprises preemptively registered "clear love" as a trademark for The Martyr Chen Xiangrong of Shubian, which was rejected and reprimanded by the State Intellectual Property Office.
During the Tokyo Olympic Games, this gray business appeared on the hot search again, and the names of Olympic athletes such as Quan Hongchan, Yang Qian, and Chen Meng were applied for trademark registration.
Now, the winter Olympic hot words are being targeted again. I have to say that people and companies who preemptively register trademarks in bad faith eat ugly!
Some squatters are out of opportunism and in order to rub hot spots; there are also some who specialize in preemptive registration to seek "private", take other people's roads, and let others have no way to go.
For these acts of trademark squatting, the functional departments should not only reject them in accordance with the law, but also warn and admonish them in accordance with the law, and even deprive the relevant trademark agencies of their qualifications according to the law.
At the same time, the law should also manage those malicious acts that occupy the trademark deliberately, so that unscrupulous enterprises cannot use the trademark; the intellectual property department should also take the initiative to activate the relevant cancellation clauses, so that the trademarks that have been preemptively registered cannot be preserved because they are not used, and the living space of "intellectual property hooligans" is completely eradicated.
