How should the procuratorial organs promote the implementation of the Family Education Promotion Law?

On January 1, 2022, the Family Education Promotion Law came into effect. How can procuratorial organs work with relevant departments for the protection of minors to implement family education guidance responsibilities? What results have been achieved?

The reporter learned from the Supreme People's Procuratorate that on the first working day of 2022, the Supreme People's Procuratorate issued a notice requiring provincial-level procuratorates to conscientiously study and comprehend the legislative spirit and content requirements of the Family Education Promotion Law, effectively enhance political consciousness, rule of law consciousness and procuratorial consciousness, and implement the relevant requirements in specific work such as jointly carrying out family education guidance, formulating and issuing supervision and supervision orders, and carrying out guardianship procuratorial supervision in conjunction with the All-China Women's Federation and the China Customs Work Committee.

Procuratorial organs at all levels immediately took action. According to reports, after the circular was issued, the Beijing procuratorial organs deployed and arranged some grass-roots procuratorates to explore the procuratorial organs' work mechanism for reprimanding and ordering them to accept family education guidance; the procuratorial organs in Kunming, Yunnan Province, and the local women's federation signed the "Work Cooperation Mechanism on Jointly Promoting the Protection of the Lawful Rights and Interests of Minors"; the Hebei procuratorial organs issued a "letter to the parents of minors" through WeChat public accounts and other carriers; the procuratorial organs of Qingshan District in Wuhan, Hubei Province, invited professional family education instructors to teach parents to their homes.

Since the implementation of the Family Education Promotion Law, procuratorial organs in many places have issued a number of supervision and guardianship orders, actively carried out family education guidance, and made up for the missing "family education classes" for parents and children.

In fact, before the implementation of the Family Education Promotion Law, procuratorial organs had already noticed the adverse impact of the lack of family guardianship on the growth of minors in handling cases.

In May 2021, the Supreme People's Procuratorate, the All-China Women's Federation and the China Customs Work Committee jointly issued the Opinions on Comprehensively Carrying Out Family Education guidance in handling cases involving minors. In June of the same year, the procuratorial organs comprehensively launched the work of "supervising and supervising guardianship orders" in handling cases involving minors.

Procuratorial organs at all levels have done the "first half" of the article on supervision and guardianship through means of guardianship intervention such as reprimands and supervision orders, guided social forces through joint professional family education, continued to carry out family education guidance, supervision and inspection, and done a good job of the "second half" of supervision and guardianship.

Statistics show that in 2021, procuratorial organs accepted 758 cases of revocation of guardianship, supported 464 prosecutions by individuals or units, revoked 388 guardianship rights, put forward 294 procuratorial suggestions, and issued a total of 19,328 "supervision and guardianship orders", of which 14,754 were sent to the guardians of juvenile criminal suspects and 4,574 to the guardians of minor victims.

In November 2021, the Supreme People's Procuratorate, the All-China Women's Federation, and the China Customs Work Committee jointly issued the "Typical Cases of Comprehensively Carrying Out Family Education Guidance Work in Handling Cases Involving Minors", and put forward clear requirements for further promoting the high-quality development of family education guidance work in cases involving minors.

The implementation of the new law has established a legal framework for family education. The relevant person in charge of the Ninth Procuratorate of the Supreme People's Procuratorate said that the Family Education Promotion Law provides strong support for procuratorial organs to promote the strengthening of the responsibility of minors to protect families, solve the deep-seated problems of juvenile crime prevention and judicial protection, and also put forward new and higher requirements for further improving juvenile procuratorial work, and the procuratorial organs will respond with practical measures.

It is understood that the Supreme People's Procuratorate has put forward clear requirements for local procuratorial organs, and by the end of 2022, all county and district-level procuratorates will establish communication and coordination mechanisms with women's federation organizations, customs work committees or relevant local government departments, form a stable family education guidance work force, explore the construction of "family education guidance workstations", and promote the coverage rate of family education assessment of minors involved in the case to reach 100%.

In addition, the procuratorial organs will continue to carry out publicity on the promotion of the law on family education, combined with the work of the vice president of the rule of law, the rule of law entering the campus, and the procuratorial open day, through the development of family education courseware, the establishment of "parent classrooms" and other means to publicize the important role of family education in the growth of minors, and create favorable conditions for the full implementation of the family education promotion law.
