Subsequently, Ms. Li spent 50 yuan to purchase the ticket snatching service provided in the APP, and upgraded the ticket snatching speed to "lightspeed ticket snatching".
In the process of waiting for the ticket to be issued, Ms. Li first received a text message prompting "the railway 12306 order was successfully cashed", and then she checked the 12306APP and found that the corresponding order had been generated in the APP. But at the same time, Ctrip's APP still shows that ticket snatching is in progress. After about 5 minutes, the Ctrip APP showed "Ticket Snatching Success".
According to the description of "Speed of Lights" in Ctrip's APP, after opening the "Lightspeed Ticket" service, 25 ticket-snatching "booster packs" will be given away, and 500M light-speed network channels will be enjoyed at the same time; in addition, if there is any reason that leads to the failure of ticket snatching, Ctrip will refund the ticket rush fee in full.
Based on the above phenomenon, Ms. Li believes that the ticket snatching operation carried out on Ctrip is actually achieved through the standby mechanism of 12306, and in the 12306 APP, the standby channel provided to users does not need to charge additional fees. In this case, Ctrip's "dual-channel ticket snatching" mechanism only allowed her to successfully obtain the alternate quota provided by 12306, and did not play the accelerated effect of Ctrip's "speed of light" to grab tickets, so she should not be charged 50 yuan for ticket snatching. Ms. Li immediately asked the online customer service in the APP whether she could refund the 50 yuan ticket rush fee, and also got a reply from the customer service that "it is impossible to unsubscribe the help package".
To this end, Ms. Li submitted a complaint to the Shanghai Changning District People's Court, the main claims are:
First, the order found that the "acceleration package" ticket snatching function of Ctrip's TRAIN TICKET constituted a fraudulent consumer behavior;
The second is to order Ctrip to refund one and pay three, refund the "acceleration package" ticket snatching fee of 50 yuan, and pay compensation of 500 yuan, a total of 550 yuan.
Ms. Li's lawyer said that Ctrip believes that ticket snatching is a market behavior based on user demand, a normal ticket purchase using the assistance of information services, and the platform has also invested a lot of technical, human and material costs in the information services.
The service is essentially the same as upgrading computer hardware and software, improving network bandwidth, and increasing the user's attention to ticketing, and the effect is mainly to help users entrust the platform to help them retrieve Internet information related to the train at the corresponding speed of the purchased product or service when they need it.
