Xiaomi's lawsuit against Xiaoai trademark was rejected

According to the Tianyancha App, on January 18, the second-instance legal documents of the relevant cases between Xiaomi Technology Co., Ltd. and the State Intellectual Property Office were made public.

According to the document, the Beijing Intellectual Property Court of the court of first instance supported the decision of the State Intellectual Property Office to reject the application for registration of Xiaomi's disputed trademark (the 29992916 "Xiaoai" trademark). Xiaomi filed an appeal, applying for the suspension of the case on the grounds that the cited trademark involved in the case was not being used for three consecutive years.

The Beijing Municipal Higher People's Court held that the disputed trademark was completely included in the "Xiao Ai Intelligent" part of the cited trademark that prominently identified the Chinese characters, which could easily cause confusion and misidentification among the relevant public about the source of the goods, so the relevant determination conclusions of the original judgment and the decision of the respondent were not improper. At the same time, Xiaomi did not produce evidence to prove that the cited trademark had been revoked and became effective. In the end, the court ruled to dismiss the appeal and upheld the original judgment.
