Decisions of some provincial government regulations
In order to further implement the deployment requirements of the national and provincial institutional reform programs, and promote the reform of simplifying administration and decentralization, combining decentralization and management, and optimizing services in accordance with the law, the provincial government has cleaned up the provincial government regulations involving institutional reform and optimizing the business environment, as well as the provincial government regulations that are no longer applicable in practice. After the clean-up, it was decided to amend and repeal 33 provincial government regulations.
1. Amend 9 Provincial Government Regulations
(1) Amendments to the Measures for the Administration of Expressways in Jilin Province:
1. The first paragraph of Article 36 is amended to read: "Expressway operation and management units shall carry out business and service activities in accordance with the business service specifications stipulated by the competent administrative department of transportation, and consciously accept the supervision and inspection of the expressway management agency." ”
2. Amend Article 48 to read: "Where, in violation of the provisions of Article 36 of these Measures, a highway operation and management unit fails to carry out business and service activities in accordance with the business service specifications, it shall be ordered to make corrections and deal with it in accordance with law." ”
(2) Make amendments to the "Jilin Province Artificial Weather Control Measures":
1. Amend Article 8 to read: "Units operating on artificially influencing weather shall conduct pre-job training for personnel engaged in artificially influencing weather operations in accordance with the training standards for operators of artificially influencing weather formulated by the competent meteorological authority under the State Council." Artificial weather operation personnel shall master the relevant operation specifications and operating procedures before implementing artificial weather influence operations. ”
2. In Article 11, "relevant departments of civil affairs, agriculture, water conservancy, forestry and so forth" is amended to read "relevant departments of agriculture and rural areas, water conservancy, natural resources, emergency management, forestry and grasslands".
(3) Make amendments to the "Jilin Provincial Measures for the Management of Enterprise Credit Information":
The "provincial financial work department" in Article 4 is amended to "provincial government service and digital construction management department".
(4) Make amendments to the "Jilin Provincial Measures for The Preferential Treatment of Military Pensions":
1. In Articles 3, 8, 10, 13, 14, 15, 16, 27, 28, 40, 42, 43 and 45, the term "civil affairs departments" is amended to read "competent departments for the work of veterans".
2. In the second paragraph of Article 13 and the third paragraph of Article 14, the word "civil affairs" is amended to read "the work of veterans".
(5) Make amendments to the "Measures for the Praise of Martyrs in Jilin Province":
In Articles 6, 9, 10, 11, 12, 13, 15, 17, 18, 22, 23, 25, 26, 33, 35, 42, 45, 46, 46, 47, 51 and 52, the "civil affairs departments" are amended to read "the competent departments for the work of retired military personnel".
(6) Make amendments to the Measures for The Relief of Natural Disasters in Jilin Province:
1. In Articles 4, 11, 19, 20, 23, 24 and 27, the term "civil affairs departments" is amended to read "emergency management departments".
2. In Articles 16, 22 and 25, the phrase "civil affairs departments" is amended to read "emergency management departments".
3. Amend the first paragraph of Article 11 to read: "The emergency management department of the Provincial People's Government shall, in conjunction with the departments of finance, development and reform, industry and informatization, grain and material reserves, respectively, formulate the reserve plan and reserve plan for natural disaster relief materials in the province, and organize their implementation." Among them, the provincial grain and material reserve department, together with relevant departments, shall formulate the provincial disaster relief material reserve plan and organize its implementation. ”
(7) Amendments to the Measures for the Expropriation and Compensation of Houses on State-Owned Land in Jilin Province:
1. The first paragraph of Article 28 is amended to read: "Where the expropriated person or the housing expropriation department has objections to the assessment results, he may apply to the real estate price appraisal agency for a review and appraisal within 10 days from the date of receipt of the appraisal report." Where there are objections to the results of the review, they may apply for appraisal to the expert committee on the appraisal of the real estate price of the place where the expropriated house is located within 10 days of receiving the results of the review and assessment. ”
2. Amend Article 37 to read: "Compensation for losses from suspension of production and business shall be determined on the basis of factors such as the benefits of the house before it was expropriated, the period for suspension of production and business, and so on." Specific standards shall be formulated by the people's governments at the municipal and county levels. ”
(8) Make amendments to the Measures for the Quality Management of Construction Projects in Jilin Province:
1. Delete Article 38.
2. Replace Article 47 with Article 46 and amend it to read: "Construction, survey, design, construction drawing review, construction, project supervision, and testing institutions shall carry out relevant business activities within the scope of qualifications prescribed by the State; their employees shall conduct business training in accordance with the provisions of the State, and where the State stipulates that they shall obtain a post certificate, they shall only take up their posts after passing the assessment and obtaining the certificate." ”
(9) Make amendments to the "Jilin Province Vehicle and Vessel Tax Implementation Measures":
1. Amend Article 3 to read: "The specific applicable tax amount for vehicles and vessels shall be implemented in accordance with the "Jilin Province Vehicle and Vessel Tax Headings and Tax Amount Table" attached to these Measures." ”
2. Add a new item to the first paragraph of Article 4 as the fourth item: "(4) National comprehensive fire rescue vehicles and national comprehensive fire rescue special ships that hang special number plates for emergency rescue;"
3. The second paragraph of Article 4 is amended to read: "Vehicles and vessels that save energy and use new energy may be reduced or exempted from vehicle and vessel tax." The specific scope of vehicles and vessels that are levied or exempted from vehicle and vessel tax shall be implemented in accordance with the relevant provisions of the State. ”
4. In Article 6, the term "provincial financial administrative department" is amended to "the financial department of the provincial people's government"; "provincial local taxation authority" is amended to "provincial taxation authority".
5. In Articles 7, 10, 11 and 13, the term "local tax authority" shall be amended to read "tax authority".
6. Article 8 is amended to read: "An insurance institution engaged in compulsory insurance for the liability of a third party of motor vehicles is the withholding agent for motor vehicle and vessel tax, and shall collect and pay the vehicle and vessel tax on behalf of the person in accordance with law." ”
7. Amend Article 9 to read: "Vehicle and vessel tax shall be declared annually, calculated on a monthly basis, and the annual tax shall be paid at one time." Where the withholding agent collects and pays the vehicle and vessel tax on behalf of the taxpayer, the taxpayer shall pay the vehicle and vessel tax at the same time as handling the compulsory insurance for the third-party liability of the motor vehicle. Taxpayers who self-declare and pay vehicle and vessel tax shall declare and pay the vehicle and vessel tax for the current year from January 1 to December 31 of each year. Taxpayers who have not paid the vehicle and vessel tax on newly purchased vehicles and vessels shall pay the vehicle and vessel tax before the 15th of the month following the occurrence of the tax obligations of the vehicles and vessels. ”
8. Amend Article 11 to read: "The departments for the registration of vehicles and vessels such as public security, transportation, agriculture and rural areas, and the competent departments for the industry of the vehicle and vessel tax withholding agent shall assist the tax authorities in the collection and management of vehicle and vessel taxes in providing information related to vehicles and vessels." ”
In addition, the order of the relevant provisions of the above-mentioned amended provincial government regulations will be adjusted accordingly.
2. Abolish 24 provincial government regulations
(1) Abolish the Detailed Rules for the Implementation of the Resettlement of Veteran Conscripts in Jilin Province (promulgated by Order No. 4 of the People's Government of Jilin Province on November 10, 1988, and amended in accordance with the Decision of the People's Government of Jilin Province on Amending the Detailed Rules for the Implementation of the Resettlement of Veteran Conscripts in Jilin Province) of Order No. 66 of the People's Government of Jilin Province on August 15, 1997).
(2) Abolish the Interim Measures for the Administration of Wage Funds in Jilin Province (promulgated by Order No. 16 of the People's Government of Jilin Province on June 15, 1989).
(3) Abolish the Implementation Measures for the Labor Protection of Female Employees in Jilin Province (promulgated by Order No. 25 of the People's Government of Jilin Province on September 11, 1989).
(4) Repeal the Several Provisions of Jilin Province on the Examination and Approval of Administrative Fees and Charges (promulgated by Order No. 52 of the People's Government of Jilin Province on January 13, 1992).
(5) Abolish the Implementation Measures for the Prevention and Control of Forest Diseases, Insects and Rat Pests in Jilin Province (promulgated by Order No. 59 of the People's Government of Jilin Province on May 11, 1992, and amended in accordance with the Decision of the People's Government of Jilin Province on Amending the Implementation Measures for the Prevention and Control of Forest Diseases, Insects, and Rat Pests in Jilin Province) of Order No. 82 of the People's Government of Jilin Province on October 15, 1997).
(6) Abolish the Administrative Measures for the Preparation and Issuance of Statistical Statements of Jilin Province (promulgated by Order No. 66 of the People's Government of Jilin Province on November 6, 1992).
(7) Abolish the Measures for the Auditing and Supervision of the Implementation of the Budget of Jilin Province (promulgated by Order No. 36 of the People's Government of Jilin Province on November 6, 1995).
(8) Repeal the Administrative Measures for the Qualification Examination and Certification of Surveying and Mapping in Jilin Province (promulgated by Order No. 38 of the People's Government of Jilin Province on December 8, 1995, and amended in accordance with the Decision of the People's Government of Jilin Province on Amending the Administrative Measures for the Qualification Examination and Certification of Surveying and Mapping Qualifications of Jilin Province) of Order No. 84 of the People's Government of Jilin Province on December 15, 1997).
(9) Repeal the Provisions of the People's Government of Jilin Province on the Amount of "Larger Fines" in the Scope of Administrative Punishment Hearings (promulgated by Order No. 58 of the People's Government of Jilin Province on January 13, 1997).
(10) Abolish the Measures for the Prevention and Control of Water Pollution in the Dongliao River Basin of Jilin Province (promulgated by Order No. 87 of the People's Government of Jilin Province on December 31, 1997).
(11) Repeal the Jilin Provincial Deed Tax Implementation Measures (promulgated by Order No. 89 of the People's Government of Jilin Province on February 27, 1998, and amended in accordance with the Decision of the People's Government of Jilin Province on Amending and Repealing Some Provincial Government Regulations no. 272 of the People's Government of Jilin Province on December 17, 2019).
(12) Abolish the Measures for the Supervision and Administration of Provincial Budget Revenue of Jilin Province (promulgated by Order No. 109 of the People's Government of Jilin Province on May 27, 1999).
(13) Repeal the Administrative Measures for the Slaughter of Livestock and Poultry in Jilin Province (promulgated by Order No. 110 of the People's Government of Jilin Province on July 9, 1999, and amended in accordance with the Decision of the People's Government of Jilin Province on Amending the Administrative Measures for the Slaughter of Livestock and Poultry in Jilin Province) issued by Order No. 161 of the People's Government of Jilin Province on May 24, 2004).
(14) Repeal the Provisions on the Administration of Private Social Welfare Institutions in Jilin Province (promulgated by Decree No. 121 of the People's Government of Jilin Province on March 30, 2001).
(15) Abolish the Implementation Measures for the Quarantine of Forest Plants in Jilin Province (promulgated by Order No. 122 of the People's Government of Jilin Province on March 30, 2001, and amended in accordance with the Decision of the People's Government of Jilin Province on Amending and Repealing Some Government Rules and Publishing the Catalogue of Existing Effective Regulations) of Order No. 195 of the People's Government of Jilin Province on November 6, 2007).
(16) Abolish the Measures for the Treatment and Storage of Radioactive Waste in Jilin Province (promulgated by Order No. 125 of the People's Government of Jilin Province on June 23, 2001).
(17) Repeal the Provisions of Jilin Province on the Administration of Judicial Appraisal of Social Professions (promulgated by Decree No. 136 of the People's Government of Jilin Province on January 21, 2002).
(xviii) Abolish the Measures of Jilin Province for Promoting the Development of Ecological Food in Changbai Mountain (promulgated by Order No. 157 of the People's Government of Jilin Province on March 4, 2004).
(19) Repeal the Several Provisions of Jilin Province on Regulating Administrative Acts and Building a Rule of Law Government (promulgated by Order No. 176 of the People's Government of Jilin Province on June 17, 2005).
(20) Repeal the Administrative Measures of Jilin Province for Regulating Government Non-tax Revenue (promulgated by Decree No. 190 of the People's Government of Jilin Province on July 24, 2007).
(21) Abolish the Implementation Measures for cultivated Land Occupancy Tax of Jilin Province (promulgated by Order No. 202 of the People's Government of Jilin Province on February 4, 2009).
(22) Repeal the Jilin Provincial Property Management Measures (promulgated by Order No. 203 of the People's Government of Jilin Province on February 27, 2009).
(23) Repeal the Several Provisions of Jilin Province on Promoting the Development of Private Education (promulgated by Order No. 209 of the People's Government of Jilin Province on January 29, 2010).
(24) Repeal the Measures for the Administration of Health Care Products of Jilin Province (promulgated by Order No. 224 of the People's Government of Jilin Province on June 25, 2011).
This Decision shall take effect on the date of promulgation.
