The dangers of drunk driving are well known, and after drinking alcohol, the consciousness cannot be controlled by themselves, and driving in such a situation is extremely dangerous. Recently, the People's Procuratorate of Dongcheng District of Beijing Municipality has examined and prosecuted such a driver who cannot control himself according to law, so let's take a look at it together.
At about 3 p.m. on January 30, 2021, during daily patrols, the police found a black car parked in the emergency lane of the main road of Beijing's Second Ring Road, and the driver slept in the car.
After breathing alcohol test, the driver's blood content is 107 mg per 100 ml of alcohol. Driver's license information shows that the driver's surname is Pan, 56 years old, just when the police asked Pan to get out of the car to accept the treatment, Pan actually kicked the accelerator and drove away from the scene.
That night, at Pan's residence, the police arrested him.
Pan said that at noon on the day of the crime, he and three friends drank four or two liquors, drove home afterwards, and were sleepy on the way, so they parked the car on the side of the road and fell asleep. After the police tested him for alcohol, Pan was afraid of being punished and fled the scene by car. After fleeing the scene, Pan did not go home, but drunk and drove to the next liquor game.
No matter how his family and the police persuaded him, Pan, who was in a drunken state, never cooperated with the police. It wasn't until the next morning, when Pan woke up drunk, that he realized that he was drunk driving and had violated the law.
Prosecutor Yan Yan said that Pan's drunken driving of a motor vehicle met the constituent elements of the crime of dangerous driving. The law enforcement recorder shows that at the time of the incident, the police stood in front of Pan's car, but Pan was drunk and opened the accelerator without scruples, and his behavior not only disregarded his own safety, but also posed a threat to the police and public safety handling the case.
According to the law, the traffic management department revoked Pan's driver's license and ordered him not to re-obtain a driver's license for 5 years. On February 8, 2021, the Dongcheng Procuratorate filed a public indictment with the court on suspicion of dangerous driving, and on February 20, the Dongcheng Court rendered a judgment on the case, and the defendant committed the crime of dangerous driving, and was sentenced to two months of detention and fined 4,000 yuan.
