Recently, the People's Procuratorate of Tongzhou District of Beijing Municipality announced a typical case of fraud. A taxi driver, in the past year, deliberately caused 19 traffic accidents, and the amount of fraud was more than 14,000 yuan.
Mr. Shi, one of the victims of the case, said that when he was driving through an intersection and was about to turn right, he looked in the rearview mirror and thought there was only one bus, but when he stepped on the accelerator to accelerate through, a taxi crashed into it.
After the accident, he negotiated with the taxi driver Zhao Mou, the taxi driver Zhao Mou proposed private, let Mr. Shi give him 3,000 yuan as compensation, Mr. Shi considered that he had insurance, and chose to call the police.
After on-site investigation and questioning, the traffic police believe that Mr. Shi changed lanes in violation of the law and caused the occurrence of traffic accidents, and was mainly responsible. Subsequently, the taxi driver said that their company had a request that the accident vehicle be repaired at the company's designated auto repair plant. Therefore, Mr. Shi paid the taxi driver Zhao 1500 yuan in advance.
However, when the police handled the accident, they found that the vehicle driven by taxi driver Zhao Mou had had 19 traffic accidents in the past year, and all of them were minor accidents caused by the responsibility of the other party. An old driver has suffered one accident after another, which makes the police suspicious of Zhao.
As a result, the police launched an investigation into the taxi driver Zhao and visited the parties responsible for a number of traffic accidents he had previously been involved in. During the investigation, the police found that among the cases involving Zhao, there were several cases similar to Mr. Shi's.
After grasping a large amount of evidence of Zhao's crime, on July 20, 2020, the police arrested Zhao. After Zhao arrived at the case, he confessed to the police the crime he had committed.
According to Zhao Mou's account, he used the other party's driver to violate the law first, create a traffic accident, and then use the illusion that the other party is fully responsible, and the psychology of the other party in a hurry to do things, suggesting that the other party solved it privately. If the other party does not agree to be private, he will let the other party call the police or call the police himself.
Using his skillful driving skills, Zhao can get compensation with a small scratch, and after obtaining compensation, he is only simple to deal with the vehicle, in case he "touches the porcelain" next time.
After investigation, taxi driver Zhao Mou committed 19 crazy crimes in Tongzhou, Daxing, Chaoyang, Fengtai and other places in Beijing from June 2019 to May 2020.
On October 26, 2020, the Tongzhou Branch of the Beijing Municipal Public Security Bureau transferred the case to the Tongzhou District People's Procuratorate of Beijing Municipality for review and prosecution. On the basis of the case file materials provided by the police, the prosecutor and the victims contacted each other and verified with them the objective circumstances of the payment of the money one by one. After a comprehensive analysis and judgment, the prosecutor finally characterized the case as a fraud.
On November 24, 2020, the Tongzhou District People's Procuratorate of Beijing Municipality filed a public prosecution with the Tongzhou District People's Court of Beijing Municipality. After trial, Zhao was sentenced to 10 months' imprisonment and fined 10,000 yuan. After the judgment in this case took effect, the procuratorate recommended that the traffic management department revoke the determination of the traffic accident involved.
