Chongqing, November 25 (China News Network) -- The Chongqing Municipal High People's Court held a press conference on November 25 to officially release the "Practical Guidelines for Case Filing" and the "Guidelines for the Jurisdiction of Civil and Commercial Cases".

The "Practical Guide to Case Filing" is divided into eight parts, which make detailed provisions on the practice of civil first-instance cases, administrative first-instance cases, criminal private prosecution cases, application for enforcement, state compensation cases, civil retrial application cases, administrative retrial application cases, and criminal appeal case filing practices, with the aim of unifying the standards for registration and filing of cases in Chongqing Municipal Courts, and solving the problems in which different courts in practice make different treatments for similar cases and similar issues.

The Guide to Case Filing Practice comprehensively sorts out the provisions on case filing in legal provisions and judicial interpretations, and summarizes the experience and practices that conform to the spirit of legislation and are effective in judicial practice. Each case type gives tips and specifications to important links and key steps in case filing from four aspects: "acceptance conditions", "determination of jurisdiction", "list of materials" and "key point tips", which has strong pertinence and operability.

As a supporting document of the Practical Guide for Case Filing, the Guidelines on the Jurisdiction of Civil and Commercial Cases systematically sort out and comprehensively and publicly determine the relevant rules for the jurisdiction of various types of civil and commercial cases, so as to improve the certainty and predictability of parties and lawyers on dispute resolution methods and case jurisdiction issues. At the same time, it will help improve the ability of parties to participate in litigation, enhance the party's sense of experience and satisfaction, and help solve the problem of "difficulty in filing a case".

Yue Xinfu, president of the First Case Filing Division of the Chongqing Municipal High People's Court, introduced that the promulgation of the "Guidelines for the Jurisdiction of Civil and Commercial Cases" is not only for the Chongqing Municipal Court to unify its understanding and resolve disputes, but also to help the parties and their lawyers accurately choose the competent court, so as to "take fewer detours" or even "no detours" in the application for case filing, reduce litigation costs, and improve work efficiency.

Li Shenglong, vice president of the Chongqing Municipal High People's Court, introduced that the Practical Guidelines for Case Filing and the Guidelines for the Jurisdiction of Civil and Commercial Cases provide clear guidance for facilitating the filing of cases and accurately determining the competent courts, and can serve as "reference books" for parties and lawyers to file lawsuits. These two documents answer the common and difficult questions of parties and lawyers when initiating lawsuits, guide parties and lawyers to accurately exercise their litigation rights, and facilitate parties and lawyers to run less, spend less money, and delay less time in the process of exercising their right of action.
