The owner of a health product shop who sold psychotropic drugs under state control was sentenced to a heavy sentence for the crime of drug trafficking

Urumqi, 26 Jun (Xinhua) -- On the occasion of the "6.26" International Day Against Narcotics, the Higher People's Court of the Xinjiang Uygur Autonomous Region announced to the outside world the trials of a number of typical drug trafficking cases. Among them, Liang Mou, the owner of the health care product store, repeatedly sold psychotropic narcotic drugs controlled by the state, constituting the crime of drug trafficking, and was sentenced to a heavy sentence and a high fine.

On September 3, 2017, the police of the police station searched a large number of aminophenol tramadol, tramadol hydrochloride, compound fenol tablets and other state-controlled drugs in the health product store operated by defendant Liang, and the police station handed Liang over to the anti-drug brigade for education and treatment, and the public security organ clearly informed Liang that diphenoxylate (narcotic drugs) and tramadol (class II psychotropic drugs) are state-controlled psychotropic drugs, and it is illegal to sell such drugs without a doctor's prescription.

On March 16, 2018, Liang was caught by the police again for the purpose of making profits by selling diphenoxylate tablets to others, and investigators once again seized a large number of compound tramadol, tramadol hydrochloride, and compound diphenoxylate tablets in his residence. The above-mentioned psychotropic drugs such as aminophenol tramadol, tramadol hydrochloride, and compound tramadol sold by Liang totaled 3146 grams, and the purified drugs contained tramadol 312.63 grams; A total of 12,930 grams of compound diphenoxylate tablets were sold, and 633.57 grams of diphenoxylate were contained in the purified drugs.

The case was tried by the Kashgar Municipal People's Court in Xinjiang, and after trial, the court held that the defendant Liang Mou, for the purpose of making profits, purchased state-controlled spiritual and narcotic drugs through illegal channels to sell to others through illegal channels without any relevant medical qualifications, and his behavior constituted the crime of drug trafficking and should be punished according to law. Accordingly, defendant Liang was sentenced to 12 years and 3 months' imprisonment and fined RMB 123,000 in accordance with law.

After the judgment was pronounced, defendant Liang did not appeal (or protest) within the statutory time limit, and the case has taken legal effect.
