From November 2017 to December 2018, defendant Zeng used the WeChat platform to place advertisements nationwide, falsely publicizing the efficacy of Yukangtang Company's aphrodisiac products, tricking the victims into actively adding weChat accounts of Yukangtang Chinese Medicine Hall, and recruiting a large number of sales personnel to carry out online fraud activities.
The salesman pretends to be a doctor, teacher, etc. through the WeChat platform, and in the absence of diagnosis and treatment ability, male medical expertise and professional qualifications, in accordance with the unified telephone mode, falsely consults and diagnoses victims with different diseases and needs.
At the same time, the salesman also falsely publicized aphrodisiac products to the victims, consulted with "old Chinese medicine", and falsely formed products with no therapeutic effects into ancestral aphrodisiac secret recipes customized for the victims, so that the victims fell into the wrong understanding that their own diseases were serious and they had to buy products to be cured.
When the victim purchased the product, the salesman then asked the victim to take photos of tongue moss, nail covers and even private parts through WeChat in accordance with the words, conducted false diagnosis and treatment, tricked the victim into re-purchasing more expensive products for the second time, and fabricated the illusion that the "old Chinese medicine" prescribed medicine after consultation.
After auditing, the fraud group defrauded a total of 3,550 victims of a total of 6,141,858.05 yuan through the above-mentioned modus operandi.
The court held that the defendant Zeng X and fourteen others used fictitious facts and concealed the truth to carry out telecommunications network fraud, the amount of which was particularly huge, and their acts had constituted the crime of fraud, and were sentenced to fixed-term imprisonment ranging from 11 years and 6 months to 1 year and 4 months, and fined.
Nandu reporter learned that in 2020, the Guangzhou court concluded 401 first-instance cases of telecommunications network fraud, sentenced 815 people, and the amount involved was more than 241 million yuan; in the first quarter of 2021, the Guangzhou court concluded 187 first-instance cases of telecommunications network fraud, sentenced 374 people, and the amount involved was more than 117 million yuan.
