Starting from "sincerity", the petitioning agent solves the troublesome problem of water leakage in the house

author:Beijing Daily client

In May this year, a water pipe on the third floor of the Beili Community at the jinding street entrance of Shijingshan District collapsed, leaking water for more than ten hours, causing serious damage to the two residential houses downstairs. However, when it came to compensation, the three owners could not reach a consensus for a long time, and the contradictions continued to escalate. In desperation, ms. Yang, the owner of the first floor, reflected her experience to the Shijingshan District Letter and Petition Office.

After receiving Ms. Yang's appeal, the Shijingshan District Letter and Petition Office found that this dispute involved multiple interests and was difficult to determine responsibility, in order to allow Ms. Yang and her neighbors to resolve the dispute as soon as possible without running errands, the District Letter and Petition Office transferred the petition to the Jinding Street Street Street Office where Ms. Yang's residential community was located, and the street letter and visit department resolved the matter on behalf of the street letter and visit department.

The staff of the street petition agency office immediately rushed to the field investigation and learned that the owner of the second floor, Ms. Meng,000, was the most heavily flooded, and the living room, kitchen, bedroom, and washroom were all spared. The furniture and wallpaper of ms. Yang's home on the first floor also have traces of being soaked in water. The staff also learned that this water leakage incident can be said to be representative of many cases involving neighborhood disputes. The three-storey owner's house is not self-occupied, and has been entrusted to a real estate company for the last two years. The owner of the third floor believes that the problem of water leakage should be the responsibility of the real estate company, so after the downstairs neighbor finds the owner of the third floor, the opinion of compensation is divergent, and the responsibility cannot be determined, resulting in the failure of self-negotiation.

Therefore, the staff of the petitioning agency office found comrades from the street judicial office and took the lead in carrying out mediation work. "After visiting, we found that the entrustment agreement of the three-storey owner expired in January this year, and the two parties did not renew the contract, but the key was still in the hands of the real estate company. From a legal point of view, the owners of the three floors should be held accountable for themselves. After chen Caiying, a staff member of the street justice office responsible for mediation, explained many times, the owners of the third floor gradually recognized the fact that they needed to bear responsibility.

Subsequently, Chen Caiying contacted other owners separately, and after understanding the demands of all parties, she carried out mediation several times, introduced cases and relevant legal knowledge on the "Shijingshan District Online Conflict Mediation Platform", and guided the three parties to reach a unified solution within the scope of reasonable appeals. After nearly half a month of coordination, the owner of the second floor and the owner of the third floor finally reached an intention to compensate, and the two sides signed the Mediation Agreement.

But the remaining first floor owners did not agree. Because the damage to the first floor is lighter than that of the second floor, but the cost proposed by the owner is much higher than that of the owner of the second floor, the two sides are deadlocked. The staff repeatedly contacted the two sides "back-to-back" to mediate contradictions and disputes, but they repeatedly ran into a wall, and the problem dragged on until September.

In the process of contacting both sides, the staff found that both sides mentioned the word "sincerity" many times, and both believed that the other party did not have the "sincerity" to resolve the contradiction. The reason why the problem has not been resolved for a long time lies in "sincerity". Therefore, the COI started from "sincerity" and let both sides of the contradiction find a third person who both knew and trusted, which gradually opened the hearts of both sides and thus resolved the contradiction. Finally, under the witness of the COI, Ms. Yang, the owner of the first floor, and the owner of the third floor also signed the Mediation Agreement. At this point, the mediation that lasted for 4 months finally came to a successful end.
