Xiangyang, December 25 (Xinhua) -- Accepting bribes from others has led to a felony and a light sentence. The Xiangcheng District Court of Xiangyang City, Hubei Province, recently rendered a judgment in the first instance: Ma Mou, a former judge of the Fancheng District Court, committed the crime of bending the law for personal gain and was sentenced to six years and six months in prison.
Defendant Ma Mou, former full-time member of the adjudication committee of the Fancheng District People's Court, served as the president of the first criminal trial division of the court. After Ma was arrested, the higher-level organs designated the Xiangcheng Procuratorate and the Xiangcheng Court to have jurisdiction over the case.
The public prosecution alleged that on the evening of July 15, 2001, Chen was invited by others to eat at a restaurant in Fancheng District, during which Wang had a dispute with Chen because of a toast, and Chen first fired a shot at the ground with an imitation 64-type pistol, and when he saw that he failed to deter others, he fired another shot at Wang's abdomen, and then left the scene. Wang Died after ineffective rescue.
In late October 2008, after Chen was arrested, the Fancheng Public Security Bureau requested arrest on suspicion of intentional homicide. However, after the case entered the stage of review, prosecution and trial, Xia Mou, who was then the internal staff of the Prosecution Section of the Fancheng Procuratorate, was entrusted by others to bribe the defendant Ma X and a number of judicial personnel, resulting in the Fancheng Court finally sentencing Chen to five years and six months in prison for committing negligence and causing death, resulting in a felony and a light sentence.
In 2012, after Chen was released after completing his sentence, he gathered many people to carry out organized crime of a triad nature, seriously endangering society. In 2018, the Xiangyang Municipal Public Security Bureau designated the Laohekou Municipal Public Security Bureau to file a case against Chen and others. On December 25, 2018, the Xiangyang Municipal Procuratorate held that the Fancheng Court's original judgment found that the facts were wrong, the application of law was improper, the procedures were wrong, and the adjudicators accepted bribes, and that Chen should be held criminally responsible for intentional homicide, and decided to file a protest with the Xiangyang Intermediate Court, and the people's court had retried the case.
On August 21, 2018, after defendant Ma was retained by the Supervision Organs, he truthfully confessed his crimes and returned 50,000 yuan of stolen money to the Supervision Organs.
At trial, the court held that defendant Ma Mou, as a judicial functionary, deliberately violated the facts and the law in criminal trial activities to bend the law in criminal trial activities for the sake of favoritism and self-interest, and the circumstances were serious, and his conduct had constituted the crime of bending the law for personal gain.
On December 23, the Xiangcheng court issued a criminal judgment: Defendant Ma Mou committed the crime of bending the law for personal gain and was sentenced to six years and six months in prison, seized the illegal gains, and handed them over to the state treasury. (End)
