After trial, the court found that a village committee in Daqiao Town, Dong'a County, and the villagers jointly planted poplar trees in the Yellow River sedimentation pond in the northwest of the village, and due to the renovation of the river in the sedimentation pond, the poplar trees needed to be removed. A village committee sold the poplar trees of the plot through bidding, and Mr. Bi won part of the bid and signed a sales contract with a village committee on October 22, 2020. Due to the needs of the dredging period of the Water Conservancy Bureau, a village committee urged Bi to take the lead in cutting down the poplar trees in the winning bid section. On October 29 of the same year, defendant Bi X, without applying for a forest logging permit, used a chain saw to harvest 199 poplar trees in the northwest of a village in Daqiao Town, Dong'a County, to the east of the sand pond. Later, according to the appraisal of Dong'a County Forestry Development Center, the amount of wood accumulated by indiscriminate logging of poplar trees reached 26.87 cubic meters. In July this year, entrusted by the Dong'e County People's Procuratorate, Shandong Expressway Honglin Engineering Technology Co., Ltd. issued a forest tree replanting plan for a village in Daqiao Town, Dong'a County, arguing that according to the calculation of three times the harvesting of forest trees, Bi Moumou should bear the ecological restoration cost of 8301 yuan, and the Dong'a County People's Procuratorate spent 5,000 yuan for this.

At trial, the court held that defendant Bi X violated the provisions of the Forest law, and without the approval of the competent forestry administrative department and other competent departments prescribed by law and issued a forest logging permit, arbitrarily harvested forest trees, the quantity was relatively large, and his behavior constituted the crime of indiscriminate logging of forest trees. The prosecution is convicted of the charges and shall be punished. In view of the fact that defendant Bi X voluntarily appeared in the case and truthfully confessed the facts of the crime, he surrendered voluntarily and may be given a lenient punishment; Based on the defendant's criminal circumstances, repentance, and pre-trial social investigation results, if there is no risk of re-offending when a suspended sentence is applied, and there is no major adverse impact on the community in which he lives, a suspended sentence may be pronounced. Defendant Bi X's indiscriminate logging behavior caused the ecological functions of the surrounding forest land to maintain water and soil, conserve water sources and other ecological functions to decrease, destroyed the ecological environment, and infringed on the national interests and social public interests, and should bear the corresponding civil liability for ecological restoration in accordance with law. Because of the cause of the indiscriminate logging behavior, the subjective malignancy is small, and the cost of ecological restoration can be compensated at one time according to the assessment opinion. In summary, based on the facts, nature, and circumstances of defendant Bi's crime and the degree of harm to society, the court made the above judgment in accordance with law.
