Youku took Station B to court? Find out!

Recently, the Beijing Intellectual Property Court rendered a final judgment on the dispute between Youku and Station B for infringement of its right to information network dissemination.

1. Youku

Youku.com is a video platform founded and officially launched by Koo Yongjun on June 21, 2006. Youku is now a video platform under the Alibaba Culture and Entertainment Group's Youku Business Group, covering membership, games, payments, intelligent hardware and artist brokerage, from content production, publicity, marketing, derivative business to fan economy, through the whole link of culture and entertainment.

2. Station B

Bilibili, now a highly concentrated cultural community and video platform for China's young generation, is operated by Shanghai Xiandian Information Technology Co., Ltd. The site was created on June 26, 2009 and is affectionately known as "Site B" by fans.

3. Case retrospective

In 2016, Youku claimed that Station B played the "Deyun Sheyi WeiNian Sealing Celebration 2016" without authorization, which enjoyed the exclusive right to disseminate information networks, and sued Shanghai Phantom Electric Information Technology Co., Ltd., the operating company of Station B, to court, asking the court to order Station B to compensate itself for 200,000 yuan.

4. Court judgment

After trial, the court of first instance held that Youku enjoyed the exclusive information network dissemination right of the program involved in the case in accordance with the law, and Station B failed to fulfill the corresponding duty of care, infringing on Youku's legitimate rights and interests. Ordered Station B to compensate Youku for 100,000 yuan. Station B appealed against the verdict.

After trial, the court of second instance held that the judgment of the court of first instance was not improper, so it rejected the appeal and upheld the original judgment.
