First of all, I am very grateful for having such an opportunity and platform today to exchange and report on my personal work situation to you. The title of my report is "Don't Forget Your Initial Intention, Be Pragmatic for the People, Abide by Justice, And Be Diligent and Responsible."
In 2004, I passed the civil service examination to enter the Lantian Procuratorate, when the procuratorate was still in the old courtyard of Tiyu Road, cooling in the summer was an electric fan, and heating in the winter was honeycomb coal, and now, when you walk into the magnificent new office building of the Lantian County People's Procuratorate in Xi'an City, you will be attracted by the new and clean working environment, where the generations of Lantian procurators embody the firm belief of "hard work, willing dedication, pioneering and innovative, law enforcement for the people, and striving for first-class"!
For this belief, we warmly receive every visitor, and in the face of their helpless eyes for help, our words are like a spring breeze that blows the sorrow in the hearts of the masses; for this belief, we have made every case a fine one, which can withstand the test of history and the evaluation of the people. While vigorously cracking down on all kinds of criminal offenses, we should pay attention to the practice of restorative judicial concepts in light criminal cases, actively resolve social contradictions, and ensure that the case is closed, so that the people can feel fairness, justice and judicial temperature in every judicial case.
In the 17 years since the procuratorate, as a public prosecutor, I handled a series of theft cases involving nine people, including Wang X and Zhai X; a series of burglary cases involving three people, including Lei X; a series of robbery cases involving seven people, including Cui X and Kang X; these cases involved many perpetrators, committed many crimes, and committed crimes in a wide range, which not only infringed on the personal and property interests of the masses, but also had a very bad impact on the masses' production and life and social order. Timely guide the public security organs to supplement the relevant evidence, so that the case was quickly handled and examined and prosecuted in accordance with the law, effectively cracked down on crime, effectively maintained social order, and protected the safety of the people's lives, among which the series of robbery cases of Cui XX and Kang XX were also recorded and broadcast by the special column of the county justice bureau, and achieved good legal and social effects. I remember that when I participated in the Xi'an Municipal Prosecutor Debate Competition in 2008, after doing the review report and writing the paper, I prepared the debate words to three o'clock in the evening, and after a short break, I participated in the morning debate session, and after the debate, the whole talent relaxed, and won the title of "Excellent Prosecutor". I think that all the persistence is probably due to the love of this profession.
Remember that in a case of arrest, the public security organs reported the arrest of the three criminal suspects involved in the case for the crime of destroying public telecommunications facilities, and the sentencing range for this crime was not less than three years to seven years of fixed-term imprisonment. The range of sentences is imprisonment for a term not exceeding three years. In the process of handling a case, the punishment of the crime is appropriate, the punishment is the crime, the evidence is carefully reviewed, and the handling is neither light nor heavy, all of which are requirements for the fairness and justice of the case.
Independently handled the case of Song xxx's organization leading pyramid scheme activities in accordance with the law, the case had a relatively large social impact, Song xxx was a deputy to the provincial people's congress before the case, through comprehensive collection and supplementary investigation of relevant evidence, court evidence cross-examination debate and argument according to law forcefully accused Song xxx, who was the initiator of the Tangyu pyramid scheme case, Song xxx admitted guilt to the facts of the crime alleged by the procuratorial organs, and the handling of the case played a positive role in cracking down on the crime of pyramid schemes.
At the same time, he also participated in the handling of the case of Wu xxx, xun xx, and other 25 people organizing and leading pyramid scheme activities, the trial process of the case lasted for three days, more than 30 defense lawyers, and the case handling team worked overtime until more than 11 p.m. on the second night, combing and summarizing the main defense views put forward by the lawyers in the previous three days of the trial, laying a good foundation for the smooth progress of the third day of the trial, the case ended at 12 p.m. on the third day, the court also made a guilty verdict, and after the trial went outside, I felt that the stars of that night were particularly bright. The air is exceptionally fresh.
In order to accurately accuse the amount of illegal business, as the procurator in charge of the case carefully examined the legality and amount of evidence of more than 100 sales documents through careful examination of the file materials, guided the public security organs to strengthen the relevant evidence, and laid a solid foundation for the court to accurately accuse Wang xxx of the amount of illegal business and the facts of the crime, during the trial, the defendant also admitted guilt and accepted punishment for the criminal facts alleged by the procuratorial organs. The court also made a guilty verdict in court based on the facts of the crime and the amount of illegal business alleged in the indictment, and the trial process of this case was also broadcast live through Sina Weibo, which effectively protected the interests of consumers and achieved good social and legal effects.
In the work of sweeping away organized crime and eliminating evil forces, the case of Zhou Hui and nine other evil forces gangs was handled in accordance with the law, the case was under great pressure, the time node should be cleared, the task was heavy, involving 12 criminal facts, the span of time from 2008 to 2017 was large, the number of case files was large, and there were many problems involved, because some criminal suspects were detained in detention centers, some were rehabilitated in compulsory drug rehabilitation centers, and some were serving sentences in Cuijiagou Prison, from the arrest stage to the examination and prosecution stage, interrogation, and the procedures for admitting guilt and accepting punishment, the interrogation workload was large, in order to accurately handle cases according to law. In order to ascertain the facts of the case and confirm the crime, I often compare and verify the facts of multiple witness testimonies and suspect confessions in the electronic volume to the elements of the crime, and the facts that sleep at night during that time also come in the mind like a small movie, carefully label the part that can confirm the crime, and guide the public security organ to investigate and collect evidence through the early intervention of the public security organs, and fix the relevant evidence in a timely manner. And through the good coordination of the four of them many times, the relevant problems of the case were solved, the case was effectively guaranteed to be handled smoothly according to law, and a procuratorial suggestion was sent to the Puhua Town Government for the case, and the case ended after 1 day of live trial, and the court also made a guilty verdict, which played a positive role in cracking down on the crimes of the criminal and evil forces.
After handling the case of Zhou Hui and other evil forces gangs, he sent away a sofa file, because during that time, zhou Hui's case was handled intensively, and a case file material for examination and prosecution after the tea cabinet was arrested was accumulated, but at this time, his heart was already calm and calm.
Case handling should not only be a simple mechanical law enforcement, but also pay attention to the work of explaining the law and reasoning, so that the criminal suspect sincerely repents of his crime, realizes the harm of his own behavior, confesses guilt and falls to the law, and effectively plays a warning role in the future. Especially in the process of handling juvenile cases, because of the characteristics of the physical and mental stage of juveniles, juvenile criminal suspects should adhere to the principles of education, rescue, reform, and help and education, remembering that there was a case in which 5 minors violently robbed the victims of a small amount of property, and in the process of trial, it was found that 5 minors had the problem of lack of responsibility for their parents to varying degrees, 3 minors were still students in school, a girl lived with her father because her parents divorced, and her father neglected discipline because she was usually busy, and in the process of interrogation, Through the education and correction of minors, the interpretation of the law and reasoning, but also let the guardian parents strengthen the guidance and care for the children in the future, and work together patiently to help them return to normal life as soon as possible, the 5 minors also realized the harm of their own behavior, understood that the parents are usually not easy, and will listen to the words of the parents in the future, and said that they will no longer commit illegal things, after the review of the case, finally made a conditional non-prosecution of the three juvenile criminal suspects in this case in accordance with the law, and made a relative non-prosecution decision for the two minors. At the same time, the municipal court also provided the Provincial Child Psychology Association to help and educate five minors.
The green leaves throwing at the earth without regret are the affection to repay the earth; although we are just ordinary prosecutors, like the sky full of stars, silently twinkling; like a drop in the ocean, flowing quietly. Time passed, the Public Prosecution Department also became a procuratorial department, during the work, no matter whether it was happy or sad, everyone was fully engaged at the moment they opened the case file, I can't remember how many noons and nights, no one asked everyone to work overtime, but everyone invariably worked overtime and did what they should do, because we are the people's procurators, worthy of the procuratorial badge on our chests.
During his tenure as deputy director of the first procuratorial department, in addition to handling cases, he also actively did a good job in docking with the second department of criminal prosecution of the Municipal People's Procuratorate, and completed various work arrangements well, among which in order to implement the No. 4 procuratorial recommendation of the Supreme People's Procuratorate, a joint meeting of 8 relevant departments was held, and a joint working mechanism for manhole covers was formulated and established, and a problem manhole cover was found through the joint work mechanism, and the manhole cover on one of the motorways was missing for a long time due to the ownership dispute, and after learning about the situation, it was reported to the leader through on-site inspection and coordinated rapid processing. The manhole cover problem was properly handled in the afternoon of the same day, and the relevant departments installed a new manhole cover in time, which played a positive role in effectively ensuring the safety under the feet of the people.
During his successive terms as deputy chief of the Prevention Section, deputy chief of the Prosecution and Application Section, head of the Case Management Office, and head of the Information Section, he was able to actively invest and pay in every post, study conscientiously, be diligent in practice, continuously improve his various business capabilities and management capabilities in his work, and dare to take responsibility, of which there are many work, many unforgettable fragments, and many things learned, which will become my precious memory and driving force for moving forward.
During the work of the Prevention Section, special prevention work was carried out on key construction projects such as the Lantian County Library, from bidding supervision to many in-depth construction sites, on-the-spot supervision of the construction of the project; in order to serve the election of the two people in the village, vehicles could not enter the mountains on snowy days, walked into the village with the leading comrades of the department to interview village officials, established "one meeting and four stations" to promote the socialization of prevention work, etc., and was responsible for the establishment of the Lantian Prevention Journal, and drafted the "Annual Report on the Prevention of Job-related Crimes of the Lantian County People's Procuratorate" It was rated as an excellent annual report by the Supreme People's Procuratorate.
During the work of the prosecution and shenke, the unforgettable thing was to work overtime with the leading comrades of the department, actively prepare to sort out more than 40 volumes of various "national civilized reception room" evaluation materials, successfully complete the material collation and assessment of the 2013 national civilized reception demonstration window evaluation work, and organize and carry out various forms of reporting and publicity week activities such as procuratorial open days and roving publicity. In accordance with the law, do a good job of evaluating cases involving law and litigation, providing assistance to criminal victims, handling criminal appeal cases, and other such work; the preliminary work experience materials of the Lantian County People's Procuratorate's reporting clues are forwarded by the Provincial People's Procuratorate's Prosecution and Application Department. In the little work, I felt the patience and meticulousness of the old comrades when they received the masses, and they did not tire of it, and realized the importance of explaining the law and reasoning for the masses and the significance of serving the people.
Timely and effective response to the global "ransomware virus" infection, while organizing computer-skilled young cadres and police to install anti-virus software on the computer of the whole hospital in accordance with the requirements, while communicating and coordinating with the superior departments and information technology company personnel in a timely manner, in the case of tight time and heavy tasks, the technology company dispatched professional and technical personnel overnight to carry out virus investigation and firewall upgrade treatment of the host computer room of our hospital, so that no computer in the hospital has a situation where the files and information are damaged due to ransomware infection.
Since his work, he has published more than 60 propaganda articles, more than 20 first-class media, and 20 research articles; at the same time, he has actively participated in various activities in the hospital, presided over activities such as reading exchange meetings and morality lectures in the hospital, compiled and distributed the "Collection of Reading and Exchange Essays" of the Lantian Procuratorate, won the title of "People's Satisfaction with Political and Legal Cadres and Policemen in Lantian County", and was rated by the hospital as "advanced work individual", "advanced individual in propaganda and research work", and advanced individual in anti-gang work.
2021 is the 100th anniversary of the founding of the Communist Party of China, the opening year of the "14th Five-Year Plan", and the historical intersection of the two centenary goals. The centenary of the party's history is a hundred years of dedication to practicing the mission of the original heart, a hundred years of laying the foundation of the blue wisps of the Yanlu Road, and a hundred years of creating brilliant and opening up the future. An era has an era theme, a generation has a generation's mission, and on the road of the new Long March, every Chinese is the protagonist and has a responsibility. A poet once said: "The meteor is choosing to sink, the sun is choosing to rise, silently choosing the starting point, proudly choosing the destination." As prosecutors, we have nothing to fear, because we carry justice on our shoulders, we have nothing to ask for, because we have already integrated our joys and sorrows into the warm and generous hearts of the people. Shouldering the sacred mission entrusted by the people with legal supervision, we should naturally hand over a satisfactory answer sheet to the masses of the people with our own practical actions of impartial law enforcement.
May there be no more dust and haze under the blue sky, and the grass on the earth will always bloom with evergreen flowers, we will not forget our original intentions, forge ahead, abide by justice, be pragmatic for the people, be diligent and responsible, guard fairness and justice with a down-to-earth style and a rigorous attitude, actively respond to the expectations and entrustments of the party and the people with loyalty, dedication, persistence, and responsibility, celebrate the 100th anniversary of the founding of the party with new responsibilities, new deeds, and new achievements, and lick the bricks and tiles for the opening year of the 14th Five-Year Plan and the construction of a well-off society, and contribute to the procuratorial force.
