How to "sell" public rental housing?
The public rental housing rented by Wang was originally rented by his stepfather, and after the death of his stepfather, the lease was transferred to Wang's name. In the middle of 2021, Wang, who was addicted to online live streaming and was in urgent need of money, thought of "selling" public rental housing to cheat money, so he listed a 15-square-meter house for 1.05 million yuan. Because of the good location of the house, soon, the first buyer, Ms. Fang, found Wang, hoping to buy the house.
Tenants of public rental housing only have the right to use the house, but do not have the ownership of the house. In order to deceive Ms. Fang's trust, Wang falsely claimed that the house would have independent property rights and property certificates after the completion of the old renovation, and then the transfer could be handled logically. In the face of Wang's packing ticket, Ms. Fang believed it to be true, and signed the "Housing Sale and Purchase Intermediary Agreement" with him on the day of the house inspection, and paid a deposit of 320,000 yuan.

However, after the agreement was signed, the renovation of the house was delayed, and Ms. Fang, who was eager to buy the house, came to the door to ask for an explanation after urging many times to no avail. But at this time, Wang pretended to be pitiful, saying that his stepfather died, his mother was sick, and he was in urgent need of surgery fees, and hoped that Ms. Fang would pay all the house payments as soon as possible, and lied that the house was going through the old renovation process, and promised to go through the transfer procedures as soon as the process was completed.
Seeing this, Ms. Fang didn't want to say more, in order to deliver the house as soon as possible, she paid a total of 700,000 yuan for the purchase of the house according to Wang's requirements. But what Ms. Fang didn't know was that in the process of paying for the house, Wang "sold" the house to someone else.
Signed a 20-year lease contract
Wang felt that "the channel for getting money from Ms. Fang was too single", so he turned his head to look for other buyers, but the second time he "sold the house", he encountered some trouble.
In February 2022, Wang concealed the fact that the house could not be transferred, and signed a house sale contract with the second buyer, Ms. Hu, with a total price of 650,000 yuan, but it didn't take long for Ms. Hu to come to the door and ask the two parties to re-sign a 20-year house lease contract.
Purchase agreement, rental agreement
It turned out that Ms. Hu went to consult a professional with the signed sales contract, and the professional pointed out that public rental housing could not be bought and sold, and the previously signed sales contract was invalid, and suggested that she re-sign a 20-year housing lease contract.
But even if the lease contract was re-signed and part of the rent of 270,000 yuan was paid, the "rent" was not smooth. It wasn't until a year and a half later that Ms. Hu got the keys to her new home, but when she led the construction team into the house to renovate, she encountered another group of people coming to see the house, and both parties claimed that the house was their own, and the two groups looked at each other.
One house is sold for four, and millions of houses are squandered
It turned out that after "selling" the house to Ms. Hu, in just half a year, Wang "sold" the public rental housing to the third buyer, Mr. Zhou, and the fourth buyer, Ms. Li. Every time he sells a house, Wang promises that after the house is renovated, he can go through the transfer procedures, and even gave a clear time node: "It is expected that in April and May 2023, we can handle the transfer." The two buyers paid him 180,000 yuan and 250,000 yuan respectively.
The buyers saw the time node that Wang said, but the transfer of the house was delayed, and they couldn't even contact Wang, so they realized that they had been deceived and immediately called the police.
"Wang has always said that his family is sick, and the purchase price is his family's life-saving money, and I see him pitiful, so I paid part of the house payment in time, but I didn't expect everything he said to be a lie!" Ms. Li, the fourth home buyer, said.

On December 19, 2023, Wang was arrested by the public security organs. After investigation, from 2021 to the occurrence of the case, Wang transferred the lease right of the co-owned housing he rented without the ability to perform, and successively signed the "Real Estate Sale and Purchase Intermediary Agreement" and "Housing Sale and Purchase Contract" with the victim Ms. Fang, Ms. Hu and other 4 buyers, respectively, and defrauded the above-mentioned victims of a total of 1.4 million yuan, most of which was used by Wang for live broadcast rewards, and the remaining money was used for personal consumption and squandering.
The procurator in charge believes that Wang, for the purpose of illegal possession, defrauded the parties of property in the process of signing and performing the contract, and the amount is particularly huge, and his behavior has violated the criminal law, and he should be investigated for criminal responsibility for the crime of contract fraud.
