In accordance with the deployment arrangement of the "Liangjian Pujiang · 2024" special rectification action for the compulsory and abuse of face recognition technology in public places, a few days ago, the Shanghai Municipal Cyberspace Administration of China, together with the Municipal Market Supervision Bureau and the Municipal State-owned Assets Supervision and Administration Commission, jointly interviewed Shanghai Shentong Metro Asset Management Co., Ltd. (hereinafter referred to as Shentong Metro) and three vending machine operators (Shanghai Bailunji Technology Development Co., Ltd., Shanghai Xurong Information Technology Co., Ltd., and Beijing Taihe Ruitong Cloud Business Technology Co., Ltd. Shanghai Branch).
During the interview, the Shanghai Municipal Cyberspace Administration notified Shentong Metro and the three enterprises of the relevant violations and carried out legal popularization, and the Municipal Market Supervision Bureau and the Municipal State-owned Assets Supervision and Administration Commission respectively put forward rectification opinions on the problems, requiring the enterprises involved to make changes as soon as they know about them, earnestly fulfill their obligations to protect personal information, and safeguard the legitimate rights and interests of consumers. The Cyberspace Administration of Shanghai requires enterprises to draw inferences from each other and conduct self-examination and self-correction, comprehensively formulate and improve internal management systems and operating procedures, implement the principle of "notification-consent" and minimum necessity in the handling of personal information, and strengthen the study and training of laws and regulations such as the Personal Information Protection Law, the Law on the Protection of Consumer Rights and Interests, and the Methods for Determining the Illegal Collection and Use of Personal Information by Apps.

Facial recognition technology may only be used to process facial information when there is a specific purpose and sufficient necessity, and strict protective measures are taken.

The "Liangjian Pujiang ·2024" special rectification action focuses on the problem of "face brushing" in important places such as sports, retail, cultural tourism, training, property and other important places to carry out centralized rectification, focuses on standardizing the application scenarios of face recognition technology, promotes enterprises to actively fulfill their face information protection obligations, and further enhances the awareness of personal information protection in the whole society.
The Cyberspace Administration of Shanghai Municipality and the Shanghai Municipal Administration for Market Regulation remind consumers to be cautious in the process of daily consumption, so that they "do not use it unless necessary, do not provide it unless necessary, and do not allow face brushing unless necessary", so as to effectively protect their rights and interests in personal information.
In the next step, the Shanghai Municipal Cyberspace Administration and the Shanghai Municipal Market Supervision Bureau will carry out on-site inspections and "look back" on the use of face recognition technology in relevant key scenarios, and will impose law enforcement penalties and media exposure on enterprises with serious problems and repeated teachings, and urge enterprises to truly build a "line of defense" for personal information protection.
