Recently, according to a parent in Zhengzhou, Henan Province, his child suddenly felt unwell and was unwilling to participate in running, and informed the teacher that he was rejected, and the school was unwilling to take responsibility for an accident during the running. A staff member of Yuntai Primary School in Zhengdong New District, Zhengzhou City, said that the judicial department is fully collecting evidence and determining responsibility after verifying the facts. The relevant staff of the Zhengdong New District Education, Culture and Sports Bureau (hereinafter referred to as the "Zhengzhou Municipal Bureau of Education, Culture and Sports") said that the staff has been sent to fully understand the situation, and at present, the school and parents are in the stage of communication and processing.

On May 21, Mr. Zhang, the parent of the student, reported to the reporter of CCTV that on the afternoon of April 29, his child felt unwell due to the rapid beating of his heart when he participated in the school sports meeting, and reported to the teacher with his classmates that he would no longer participate in the 200-meter event of the sports meeting, but the teacher refused, and he lost consciousness and fell down after running about 100 meters. After being admitted to the hospital, the child stayed in the ICU for more than 20 days and was diagnosed with brain death by the hospital. On the evening of May 21, the child died.

Whether the student is unwell

Inform the teacher in advance

Both sides have their own opinions

Mr. Zhang, a parent, believed that the teacher did not specifically check the student's physical condition and forced the student to participate in the competition, and with the consent of the student's parents, he had contacted the student who had reported the situation to the teacher with his child at that time, and the student recounted the situation reported to him before the competition.

In response to this detail, the school staff said that they had learned about the situation from the teacher involved and found that there was no situation where the student and his classmates reported to the teacher that they were unwell before the competition, and said that on the morning of May 20, the local police station had checked with the teacher involved.

In response to why the school only found the teacher involved to inquire about the situation, and did not ask the child's classmates mentioned by Mr. Zhang to understand the situation, the school staff told the CCTV reporter that because the students are minors, out of the privacy protection of minors, the public security organs should investigate, and the school will not talk to the students alone, so as not to cause unnecessary guidance. It is hoped that only after the judicial organs have clearly investigated the facts and identified the responsibilities can the subsequent incidents be promoted.

Mr. Zhang, a parent, said that the police did not investigate the details and did not have the relevant evidence. The reporter called the Baisha Police Station of the Zhongmu County Public Security Bureau in Zhengzhou City, and said that he would not accept the interview.

Certificate of Diagnosis (provided by the student's parents)

Parents questioned the lack of timely treatment

Brain death due to prolonged lack of oxygen to the brain

Mr. Zhang, a parent, said that the hospital diagnosed the child's heart as completely normal, and the examination of various diseases was also normal. The school did not send the child to the hospital for treatment in time, resulting in apnea and brain hypoxia for too long, and the hospital diagnosed brain death.

The school staff said that after the incident at 14:35 on the same day, the school health care doctor arrived at the scene for emergency treatment and cardiopulmonary resuscitation as soon as possible, and the school physical education teacher dialed 120 synchronously, and the head teacher contacted the parents of the students. During the rescue period, the school teachers went to the nearby Fengming Hospital to find doctors to come to the rescue. At 14:57, the ambulance of Zhengzhou Fuwai Hospital arrived at the playground and took over the first aid-related work, and after the student recovered his heartbeat and breathing, the ambulance departed from the school and arrived at the hospital for treatment as soon as possible.

According to the certificate of diagnosis, the student was admitted to the hospital on April 29 and discharged on May 21. The discharge diagnosis was: fulminant myocarditis, heart failure, cardiogenic shock, respiratory and cardiac arrest, successful cardiac arrest resuscitation, sequelae of ischemic-hypoxic encephalopathy, pulmonary infection, etc.

About post-event compensation

Negotiations or judicial proceedings are ongoing

After the incident, Mr. Zhang, a parent, said that the school's attitude now is that he always believes that he is not responsible, and if he wants to solve it, he can go through the judicial process.

The school staff said that during the more than 20 days of treatment, the school paid 150,000 yuan in advance for medical expenses. As for the follow-up handling of the incident, consultations are currently underway, and if the negotiation cannot be resolved, it will be resolved through judicial litigation.

The staff of the Zhengzhou Municipal Bureau of Education, Culture and Sports said that after the incident, the staff of the Safety Letters and Visits Department had been arranged to the school to understand the situation as soon as possible, and at present, the school and parents are in the stage of communication and processing.

Deng Qianqiu, a lawyer at Beijing Zhongwen Law Firm, said that schools have a legal obligation to protect minor students, and have the responsibility to actively prevent the occurrence of student injury accidents. If there is a fault in any of the above links, such as the student's physical abnormality should be discovered but not discovered, or the student should be actively sent to the hospital but delayed, etc., they shall bear the corresponding civil liability. Whether the student has complained that he is physically unfit to participate in the relevant sports activities is an important factor in judging the severity of the school's fault. Although the school issued a statement of the incident, this statement is unilateral, and the real situation needs to be further verified.

At the same time, the lawyer also said that the "Law of the People's Republic of China on the Protection of Minors" requires schools to formulate emergency plans for emergencies and accidental injuries, equip them with corresponding facilities and conduct necessary drills on a regular basis. This will improve the school's ability to deal with emergencies and accidental injuries, the safety management of student sports events is directly related to the life safety and health of students, and a reasonable management system can prevent and resolve safety risks and protect the interests of students to the greatest extent.
