Today (May 17), the Changning District People's Court and the Changning District Disabled Persons' Federation held a press conference on the 2024 litigation services involving persons with disabilities. At the meeting, the "Specific Measures of the Shanghai Changning District People's Court and the Shanghai Changning District Disabled Persons' Federation on Providing Better Litigation Services for Persons with Disabilities" (hereinafter referred to as the "Specific Measures") were announced, and typical cases (cases) involving litigation services involving persons with disabilities were released.
May 19 is the 34th National Day for the Disabled. In February this year, the Supreme People's Court and the China Disabled Persons' Federation jointly issued the "Ten Opinions on Providing Better Litigation Services for Persons with Disabilities", promoting the work of judicial assistance to the disabled to a new level.
For a long time, how to provide high-quality litigation services for the disabled has been an important direction for the Changning District People's Court to actively explore. Under the new situation, in the face of new propositions such as the barrier-free construction of litigation services in the people's courts and the governance of litigation sources involving persons with disabilities, the Changning District People's Court has firmly established the principle of justice for the people and active performance of duties in accordance with the law, and formulated specific measures to provide more high-quality litigation services for persons with disabilities based on the principle of protecting the litigation rights and interests of persons with disabilities, so as to ensure that persons with disabilities enjoy equal, adequate, convenient and efficient judicial services.
Hardware facilities to facilitate the participation of persons with disabilities in litigation activities, software services that demonstrate judicial warmth, and institutional arrangements to meet the needs of persons with disabilities for fairness and justice...... The 8 "Specific Measures" released this time are not only targeted and operable, but also very warm.
Among them, "carrying out one-stop tour services" has attracted much attention. During the event, the "Rainbow Bridge" rule of law workstation set up by the District People's Court in the District Disabled Persons' Federation was officially inaugurated. In the future, the rule of law workstation will provide one-stop litigation services, and carry out legal consultation, litigation guidance, door-to-door case filing, mediation and resolution for persons with disabilities, so as to truly facilitate the participation of persons with disabilities in litigation and realize the resolution of conflicts and disputes on the spot.
At the scene, the Changning District People's Court released five typical cases (matters) since 2023, covering the "whole chain" of litigation rights protection for persons with disabilities before, during, and connecting litigation and non-litigation procedures, including innovative measures to open up the "last mile" of litigation services for persons with disabilities, as well as heart-warming arrangements such as opening up green service windows and ensuring the right to participate in litigation fairly.
It is not difficult to see from the "vehicle leasing contract dispute case between a certain person and a car rental company in Shanghai" that disabled people often fall into a vulnerable position before the dispute is formed due to their own objective conditions, however, judicial fairness is the last line of defense for social justice, and it is also the duty that every judicial worker must adhere to. "Conflict and dispute resolution personnel should pay special attention to protecting the fair participation rights of parties with disabilities from the source and procedures, and only by tightening the string of justice at all times can we ensure the fairness of the outcome of dispute resolution." The judge said.
As the first activity of the "Rainbow Bridge" rule of law workstation, the judges of the case filing division gave lectures on legal issues of concern to residents' representatives.
The signing ceremony of the "Agreement on Party Building and Joint Construction" between the Branch Committee of the Case Filing Division of the Changning District People's Court and the Branch Committee of the Shanghai Changning District Disabled Persons' Federation of the Communist Party of China was also held at the event. Next, the two sides will take the joint construction of party building and the establishment of the "Rainbow Bridge" rule of law workstation as the starting point of the system, and form a joint force between the court and the Disabled Persons' Federation to resolve disputes involving the disabled.
