19,800 to enter a central enterprise?

author:Small Fish News

"The landing rate of more than 10,000 (yuan) is 93%, and the landing rate of more than 30,000 (yuan) is 98%", "more than 30,000 (yuan) are mainly power grid, tobacco, railway, bank, petroleum, and military enterprises"...... Under the temptation of the attractive "landing rate" and the ability to help her children enter the employment of central enterprises and state-owned enterprises, since the end of 2023, Ms. Cheng, a parent in Nanjing, has spent nearly 40,000 yuan to buy job search services for her children. But what she didn't expect was that not only did the child have no job at present, but there was no way to recover the fees paid.

It is the graduation season of the 2024 college students, and recently, the reporter received complaints from many readers that a company called "Cainiao Worry-free" charges tens of thousands of yuan, or even tens of thousands of yuan, in the name of helping job seekers recommend them to state-owned enterprises and central enterprises, and give priority to admission. The reporter searched for the keyword "rookie worry-free" on the black cat complaint platform, and as of May 14, there were more than 100 complaints about the complaints, mainly involving false propaganda, overlord clauses, etc.

On May 8, the reporter contacted the customer service of "rookie worry-free" in the name of the parents of college students, and the other party said that the company has cooperative enterprises that can provide employment services and courses according to the situation of students.

Recently, the official recruitment platforms of PetroChina, State Grid, China Tobacco and other companies have also released the latest recruitment announcements for college graduates, and made it clear that their recruitment official websites are the only official channels, and they have not authorized other institutions to publish recruitment information or organize any counseling and training.

On May 14, the reporter asked the relevant person in charge for confirmation through the "rookie worry-free" customer service, and Ms. Yanan, who claimed to be the vice president of the company, responded that the company does employment guidance for college students, focusing on consultation and training, and said that it will understand the relevant complaints and will also supervise and punish illegal sales. She said, "Some time ago, our quality supervision department found that individual sales in order to sign orders, said a little exaggerated, the company punished individual sales and internal publicity, after the second docking, some parents also refunded." ”

Spend 10,000 yuan on intermediary fees to collect a bunch of "written test questions for central state-owned enterprises"

For the past few months, Ms. Cheng, a parent in Nanjing, has been regretting her choice.

In order to help her daughter find a job in a state-owned enterprise or central enterprise, she will transfer nearly 40,000 yuan to Beijing Cainiao Wuwu Education Technology Co., Ltd. from the end of 2023. "'Rookie worry-free' said in the live broadcast on the short video platform, saying that there are high-quality job resources of central enterprises, which can help children find good jobs, and many people say that they rely on them to 'go ashore'."

In mid-October 2023, after learning about "rookie worry-free" through the short video platform, she established contact with the company's sales staff, who said that as long as she paid 19,800 yuan to buy the "whole process class of job search in central state-owned enterprises", she could recommend a position in a state-owned enterprise to her daughter, and promised to report a class of more than 30,000 yuan to have a 98% landing rate when communicating on WeChat.

On October 31, 2023, after transferring 19,800 yuan to the other party, Ms. Cheng's daughter was pulled into a WeChat group, but the recommendations in the group were all jobs in insurance institutions and local commercial banks, which were completely different from what was promised before. "We can vote for these companies and positions ourselves, and we don't need to go through them at all. My daughter is studying in an art school, and the job offer does not meet the child's employment requirements. Ms. Cheng recalled that she learned through her relatives that the Tobacco Monopoly Bureau had released the post, and hoped that "rookie worry-free" would help her daughter "push" in, but in the end, her daughter's resume was directly rejected on the grounds of professional restrictions.

Mr. Zhang, who lives in Beijing, had a similar experience. Mr. Zhang's son attends a sports college in Hebei Province and is about to graduate and has never found a suitable job. In mid-September 2023, after Mr. Zhang contacted "Cainiao Worry-free", the other party offered an intermediary fee of 20,000 yuan, and Mr. Zhang bargained to 19,800 yuan and paid the fee.

"My child is a sports student, and his grades in cultural classes are not high, and the other party gave him a bunch of question banks for children to do questions, and also gave some links for children to submit resumes, and there was no chance of an interview at all." Mr. Zhang told reporters that the other party gave a lot of "written test questions for central state-owned enterprises", saying that there was no problem with any central state-owned enterprise after studying these tests. But the child submitted a lot of resumes and still failed in the sea. Mr. Zhang asked for a refund to "Cainiao Worry-free", and the relevant sales staff took out a detailed list of expenses, saying that only some unpaid fees could be refunded, and the refundable fees were only a few thousand yuan after calculation. The reporter saw that in this service order totaling more than 10,000 yuan, the price of the written test course was as high as 4,999 yuan, and the other party said that it had been paid, while Mr. Zhang said that the child only received some test questions transferred to the group.

Sales let spend money to be promoted, and it is claimed to be selected by the chairman

What made Ms. Cheng feel even more "pitted" was that not only did she not find a suitable job after paying nearly 20,000 yuan, but less than a month later, the salesperson asked her for money again on the grounds of upgrading the "special class". On November 22, 2023, the salesperson said, "Mr. Yuan personally led the employment", allowing her to increase the cost.

The "Mr. Yuan" mentioned by the salesperson is Yuan Jun, the legal representative of the company. Tianyancha shows that Beijing Cainiao Worry-free Education Technology Co., Ltd. was established in November 2015 with a registered capital of 2 million yuan, and the current chairman and founder of Cainiao Worry-free is Yuan Jun.

On major short video platforms, the accounts of "Yuan Jun takes college students to find jobs for employment" and "Yuan Jun takes you to find jobs for central state-owned enterprises" are very active, saying that they have attended human resources summit forums and research-based conferences many times, and also provide employment guidance in many domestic universities. He has publicly stated that the company has been paying attention to the human resources dynamics of central state-owned enterprises for many years, and "we know what kind of college students can enter central state-owned enterprises more smoothly through systematic training and consultation."

The screenshot of the chat provided by Ms. Cheng shows that the salesperson with the note "Assistant Yuan Jun" (the first time to sell the course) told her that "Mr. Yuan personally took 10 students" and selected her daughter, who could spend money to upgrade the course, and emphasized that it was "Mr. Yuan's resume". He told Ms. Cheng that this discount is only for old students, "these 10 children, State Grid, tobacco, military industry, oil offer", as long as you pay more money, you can be promoted, if Ms. Cheng does not sign up, he will screen others.

19,800 to enter a central enterprise?

"I was in the hospital at the time, and I was very excited to hear the news, so I quickly asked for a place for my child." The next day, Ms. Cheng transferred another 19,800 yuan to the other party to upgrade the "special class". Unexpectedly, they didn't wait for "Mr. Yuan" at all, and the newly established small group just changed a few instructors, serving "changing the soup but not the medicine".

In the screenshot provided by Ms. Cheng, Yuan Jun is not among the group members of the special class. When Ms. Cheng asked the other party why she didn't take it directly as promised, the other party replied "Teacher Yuan recommended it, but not the class teacher". Ms. Cheng told reporters that after this promotion, her daughter was not recommended successfully, nor did she receive personal guidance from Yuan Jun.

Ms. Cheng admitted that she transferred money many times because the other party promised to refund the money during the WeChat chat. For example, the other party mentioned that "if the child does not cooperate, the full amount will be refunded". Ms. Cheng showed the reporter a screenshot of the WeChat chat, saying that she had tried to put these promises into the contract, and asked the other party if she could indicate "refund the tuition fee when you go ashore" (Ms. Cheng said that the other party had verbally mentioned it as "ashore scholarship"), but the other party refused on the grounds that "it belongs to the welfare policy of the special class and cannot be written in the contract".

The Ministry of Education reminds graduates to be wary of the trap of "paid internal referral".

At the end of February 2023, Ms. Yin, a parent in Anhui who paid 17,800 yuan to buy the "rookie worry-free" service, also felt that she was "fooled".

Ms. Yin said that the child submitted her resume according to the position provided by the other party, and there was no news for several months. In the screenshot of the chat provided by Ms. Yin, when she asked the instructor why she recommended the expired position, the other party did not respond and ignored it.

Both Ms. Cheng and Mr. Zhang said that the service teachers of "Cainiao Worry-free" sent many companies to test questions and links to submit resumes on the grounds that they let their children study. The child did not get anything after handing in a large number of resumes pointed out by the other party. Occasionally, job-seeking students will receive a test email asking them to click on the link to take the written test online, but there will be no follow-up after the test.

The screenshot provided by Mr. Zhang shows that the child has received test emails from China State Construction Group Co., Ltd., Chinese People's Insurance Group, etc., which are displayed as "campus recruitment tests", and one person does one code to do the questions. Mr. Zhang's son told reporters that the written test question type is very difficult, including "line test text" and "line test theory" (administrative vocational ability test), the question type has reasoning questions, article reading questions, sentence analysis questions, etc., although the other party gives the question bank has the corresponding test question template, but the online test is new questions, has not been repeated, and there is no result after submitting it. "It's true that I learned through them that I was going to take these exams, but it was useless to know, and I still wouldn't do it." Xiao Zhang said that this is also the reason why he wants his father to give up and continue to accept the other party's services.

Ms. Cheng's daughter also received a test link from "China State Construction Group Co., Ltd.", with the name "China Construction Campus Recruitment Unified Examination Second Round Test", and the domain name was the same as that received by Mr. Zhang's son. The reporter inquired and found that the domain name belongs to Beijing Beisen Cloud Computing Co., Ltd.

Tianyancha shows that this is an enterprise mainly engaged in the promotion of science and technology and the application of services, the official website shows that human resources services are the main business, the reporter contacted Beisen pre-sales consultants, and the other party said that this is the "recruitment evaluation" issued by China State Construction Group Co., Ltd. using Beisen's system.

The reporter called the customer service number of Beisen, and the other party said that the company directly connected with the enterprise side (recruiting company), and the system of enterprise procurement Beisen sent evaluations to candidates, "The evaluations are all issued by the company itself." Another customer service staff said that as long as you submit your resume to the company, you will receive an evaluation email, including psychological tests, professional tests, etc., and will further go through the application process after passing.

A person in charge of human resources told reporters that this is a test after submitting a resume, and only after passing can you have the opportunity to enter the further written test and interview opportunity.

On May 8, the reporter called the State Grid human resources recruitment and social security policies and regulations consultation hotline, and the service staff told reporters that the website of the State Grid human resources recruitment platform is "State Grid Human Resources Recruitment Platform (zhaopin.sgcc.com.cn), which is completely free to sign up, and the registration time is twice a year," Don't believe the rest, especially if you spend money. ”

The 2024 college graduate recruitment announcement published on the website of the "State Grid Corporation of China Human Resources Recruitment Platform" also states that it does not authorize other websites, social media, individuals or institutions to publish any recruitment information. After checking the recruitment official websites of a number of central state-owned enterprises, the reporter found that PetroChina and China Tobacco made it clear in the recruitment announcements for college graduates that the recruitment information of college graduates was released through the company's official recruitment platform, and there was no other way to register. For example, China Tobacco emphasized in the 2024 college graduate recruitment announcement released on its official recruitment website, "The registration website of this announcement is the only website for applicants to register, and other institutions are not entrusted to reprint the recruitment information, and the registration information submitted by applicants through other linked websites is invalid." ”

In addition, State Grid, PetroChina, China Tobacco, etc. all mentioned in the recruitment announcement for college graduates that there is no charge for recruitment, the company does not organize any pre-examination training, will not entrust any institution to hold exam coaching training courses, and does not specify the tutoring book. Candidates are reminded to be vigilant and not to be deceived.

"We have cooperated with many central state-owned enterprises, and the state has never confiscated students' money. Students must be reminded that there is no charge for formal recruitment. Chang Hongwu, director of the Career Guidance Center of the University of Chinese Academy of Sciences, introduced that the so-called "internal recommendation" refers to the employees of central state-owned enterprises can recommend outstanding junior brothers and sisters to apply for jobs or internships in the enterprise.

Chang Hongwu reminded students and parents to submit resumes through formal channels in job hunting and be wary of fee traps. "Now that the information is open, all central state-owned enterprises have their own official recruitment platforms, there are formal channels for submitting resumes to apply, and schools also have formal school recruitment opportunities." Chang Hongwu introduced that the company's human resources are only going through the recruitment process, and the written examination and interview will also be assessed by the technical department within the enterprise, "now the recruitment is becoming more and more standardized."

The reporter noticed that in April 2023, the Ministry of Education reminded students looking for jobs to avoid "stepping on pits", emphasizing that they should not take the so-called "shortcut to job hunting" so as not to fall into the "trap" of employment.

"'Paid internal referral' refers to the fact that some institutions promise job seekers to provide jobs in high-tech industries, but they must pay relevant service fees, and 'paid internal referral' is suspected of unfair competition and fraud, and it is difficult for relevant job seekers to claim their own rights and interests. In the job search, don't believe the recruitment information with no requirements and unusually high salary, after all, pie will not fall from the sky, and it is often traps that fall. The Ministry of Education emphasized.

Lawyer: Failure to meet the criteria agreed upon in writing or orally is a breach of contract

"Parents, can your child still find a job if you refund the fee? How difficult is it to get a job this year, how can you still listen to your children's nonsense? "Do you know how many jobs you have this year? Our company is next to Tsinghua University and Peking University, Tsinghua University, Peking University, National People's Congress, Beijing University of Posts and Communications, Beijing Institute of Technology, Beihang University, all of which are 985 (universities), and now they haven't found a job. In a screenshot of the chat provided by Mr. Zhang, after he expressed the idea that the child wanted a refund to the "rookie worry-free" teacher, the other party persuaded him.

On the black cat complaint platform, some rights defenders reported that "rookie worry-free" seized the psychology of parents hoping to help their children find a good job and charged fees, and when the children tried to stop parents from buying employment services, the salesperson was suspected of creating employment anxiety and inducing parents to pay.

The reporter noticed that on the black cat complaint platform, Xiaohongshu and short video platforms, there are complaints about "rookie worry-free", and the content of the complaints is mostly "overlord clauses" and "false publicity", and the content of the complaints is similar to the experience of Ms. Cheng and Mr. Zhang. Taking the black cat complaint platform as an example, there have been more than 100 complaints about "rookie worry-free", of which nearly 30 have been complained since January this year, and the amount involved is concentrated in the range of 19,800 yuan.

Ms. Cheng, a parent, contacted Yuan Jun through WeChat and other means to request a refund. However, the account only replied that it contacted the instructor directly, and there was no follow-up, and the salesperson who had promised a refund repeatedly shirked or even did not answer the phone.

At present, Mr. Zhang has sued "Cainiao Worry-free" for refund. However, the dilemma faced by activist parents is that there is no clause in the contract that guarantees access to central state-owned enterprises. According to the contract provided by Mr. Zhang, he purchased "employment consulting services", which included recorded classes, written examinations, interview questions, and mock examinations. Among them, it is also indicated in bold that "since the results of job hunting are highly dependent on Party B's (job seeker)'s own mastery of knowledge, Party A does not make any form of guarantee or commitment to the results of job search and the employment pass rate"; The special conditions for the termination of the agreement and the refund of the actual expenses stipulated in the agreement are only "if the participant has a serious illness after the course has been opened and cannot continue to participate in the training".

How can consumers protect their rights in this situation? Can a salesperson's verbal commitment be used as evidence? What legal issues may exist during the training process?

"This situation is very common in various education and training fields, sales staff in order to complete the performance, to the parties to all kinds of promises, once there is a dispute, the parties look through the contract only to find that it is not the case at all." In this regard, Huang Xiaoyu, a lawyer at Beijing Yingke Law Firm, said that contracts do not have to be in written form, and the Civil Code of the mainland also recognizes the validity of oral forms for civil juristic acts.

"The verbal commitment of the staff of the training institution, even if it is not on paper, can be regarded as part of the contract, but the key is that the parties can prove it." Huang Xiaoyu said that unlike written contracts, the party who makes oral commitments often makes them through voice, telephone and other means. If the parties fail to make the recording, they are likely to fall into the dilemma of not being able to provide evidence.

"Don't believe what the other party says, it's best to put everything on paper to be safe." Huang Xiaoyu suggested that if the evidence in the hands of the parties is relatively sufficient, they can take the form of litigation to protect their own rights and interests.

Regarding the possible legal problems in the training process of "Cainiao Worry-free", Huang Xiaoyu said that according to the description of the parents, the two parties may form a similar contractual relationship such as education and training. "To put it simply, if the training services provided by the institution do not meet the standards agreed in writing or orally, it is a breach of contract." Huang Xiaoyu explained that after a party breaches the contract, it can require it to continue to perform, take remedial measures or compensate for losses and bear the liability for breach of contract.

"The employment of children is indeed a big deal for the family, but you can't rush to the doctor." Huang Xiaoyu reminded that parents should especially stay calm and not easily believe the advertisements on the Internet.
