The public prosecution alleged that the Xingning District Municipal Sanitation Management Station was a fully funded financial subsidy institution, and the defendant Could make 11 other people as non-staff drivers of the station, responsible for the operation of washing and sweeping vehicles, and responsible for managing vehicles and vehicle oil. Since 2017, Fangnengzao has conspired with 10 people including Huang Hongnai, taking advantage of the convenience of Huang Hongnai and 10 other people as the driver of the washing and sweeping car at the station, extracting diesel from the washing and sweeping vehicles driven by 10 people such as Huang Hongnai, and the two sides agreed to go to Yongwu Road in Xingning District, Shishan Park in Xingning District and other road sections, and Fangneng Chuang would separately extract the diesel fuel of the washing vehicles operated by 10 people such as Huang Hongnai and buy back diesel fuel from 10 people including Huang Hongnai at a price ranging from 90-120 yuan per barrel. Only then can it be sold to others for profit at a price of 20 yuan per barrel. The evidence in the case confirms that Fang Nengzao extracted a total of 743,750 yuan of diesel fuel from the washing and sweeping trucks responsible for 10 people including Huang Hongnai.
The public prosecution organ held that the defendants Fang Nengzao, Huang Hongnai, and others took advantage of their positions to steal public or private property of the unit, and their acts violated article 382 of the Criminal Law of the People's Republic of China, the facts of the crime were clear, the evidence was credible and sufficient, and they should be investigated for criminal responsibility for the crime of embezzlement.
During the trial, the public prosecutor forcefully charged the crime by interrogating the defendant in accordance with the law, presenting evidence for cross-examination, issuing a public prosecution opinion, and conducting full debate with the defender on the focus of the dispute in the case.
