Since the beginning of this year, the Yanbian Prefecture Procuratorate has adhered to the active performance of its duties, optimized the allocation of judicial resources, and cooperated with the Prefecture Public Security Bureau, the Prefecture Court, the Prefecture Bureau of Justice and other departments to vigorously promote the one-stop handling mechanism for the investigation, prosecution and trial of minor criminal cases, and took the lead in carrying out the pilot work of the one-stop rapid handling mechanism for minor criminal cases in Yanji City and Dunhua City. On April 22, the Yanbian Prefecture Procuratorate, together with the Prefecture Court, the Prefecture Public Security Bureau, and the Prefecture Bureau of Justice, jointly issued the "Measures for Carrying out the Pilot Work of the "One-Stop" Rapid Handling Mechanism for Minor Criminal Cases", which was immediately promoted and explored for operation.
On the afternoon of April 25, the Yanji Municipal Procuratorate, as a pilot unit, announced the verdict in court in the "one-stop" handling center for six dangerous driving cases that were reviewed and prosecuted for the first time by applying the "one-stop" handling mechanism for misdemeanors after completing the preparations for system access and personnel composition. The six cases adopted the "N days + 48 hours" model and the "48 hours" mode respectively, that is, the minimum time to complete the investigation, prosecution and trial was not more than 48 hours, and the longest was not more than 5 working days, truly realizing the quick handling of simple cases. For example, in the case of Hao's dangerous driving, the Yanji Municipal Public Security Bureau transferred the case to the Yanji Municipal Procuratorate for review and prosecution after filing the case on the morning of April 25, 2024.
Through the close cooperation and concerted efforts of the public security, procuratorate, judicial and judicial departments, these six cases completed all the litigation procedures within 48 hours from the filing of the case by the public security organs, the examination and prosecution by the procuratorial organs, to the announcement of the verdict by the courts, and this is the first time that the 48-hour rapid handling mechanism for minor criminal cases has been applied in Yanbian Prefecture. On the premise of ensuring the quality of case handling, the work process has been simplified, the time limit for case handling has been shortened, the efficiency of litigation has been greatly improved, and judicial resources have been effectively saved.
In the next step, the Yanbian Prefecture Procuratorate will closely focus on the governance of misdemeanors, solidly promote the pilot work, continue to explore a new model of modernization of misdemeanor governance, improve the awareness of reform, strengthen demonstration and guidance, so that the "one-stop" handling of minor crimes has "chapters" to follow and "evidence" to follow, timely solidify experience, optimize the trial process and technical support, lay a solid foundation for Yanbian Prefecture to comprehensively carry out the "one-stop" rapid handling of minor criminal cases, and create a procuratorial misdemeanor governance system with Jilin characteristics.
