1. Article 351 of the Criminal Law of the People's Republic of China for the crime of illegally cultivating narcotic plants:
Illegal cultivation of opium poppy, marijuana, and other narcotic plants shall be forcibly eradicated. In any of the following circumstances, a sentence of up to five years imprisonment, short-term detention or controlled release is to be given, and a concurrent fine:
(1) Planting 500 or more opium poppies but less than 3,000 or a relatively large number of other narcotic plants;
(2) Planting again after being handled by the public security organs;
(3) Resisting eradication.
Whoever illegally cultivates 3,000 or more opium poppies or other narcotic plants in large quantities shall be sentenced to fixed-term imprisonment of not less than five years and shall also be fined or have his property confiscated.
Illegal cultivation of opium poppy or other narcotic plants may be exempted from punishment if they are automatically eradicated before harvesting.
2. Article 71 of the Law of the People's Republic of China on Public Security Administration Penalties stipulates that:
Those who commit any of the following acts are to be detained for between 10 and 15 days and may be concurrently fined up to 3,000 RMB;
(1) Illegally cultivating less than 500 opium poppy plants or other small quantities of narcotic plants;
(2) Illegally buying, selling, transporting, carrying, or possessing small quantities of seeds or seedlings of uninactivated opium poppy or other narcotic plants;
(3) Illegally transporting, buying, selling, storing, or using small quantities of opium poppy husks.
Where there is conduct in item (1) of the preceding paragraph, and it is eradicated on their own before maturity, punishment is not to be given.
