Refusal of an application for variety rights
(1) In accordance with the provisions of Article 28 of the Regulations of the People's Republic of China on the Protection of New Plant Varieties and Article 35 of the Detailed Rules for the Implementation of the Regulations of the People's Republic of China on the Protection of New Plant Varieties (Agricultural Part), the application for variety rights shall be rejected if the application documents are still not in accordance with the provisions after the applicant has supplemented and corrected the application documents.
(2) After examination, the following variety right applications do not meet the novelty provisions of Article 90 of the Seed Law of the People's Republic of China, and are rejected in accordance with the provisions of Article 31 of the Regulations of the People's Republic of China on the Protection of New Plant Varieties.

Withdrawal of an application for variety rights
In accordance with the provisions of Article 25 of the Regulations of the People's Republic of China on the Protection of New Plant Varieties, the following variety right applicants are allowed to withdraw their variety right applications.

The application for variety right shall be deemed to be withdrawn
According to Article 39 of the Detailed Rules for the Implementation of the Regulations of the People's Republic of China on the Protection of New Plant Varieties (Agricultural Part), if the applicant for the following variety right application fails to reply to the examination opinion within the prescribed time limit, the application for variety right shall be deemed to be withdrawn.
