10 years of out-of-print jurisprudence: This 200-year-old book has nourished generations of star-studded jurists

author:Mai reads the law reading

The greatest jurist in German history "There is no one!"

He began to study law at the age of 16 and wrote his amazing masterpiece "On Possession" at the age of 24, and was known as "our first civil jurist".

He was born in a noble family, but his parents died early, and he was taciturn, diligent and knowledgeable all his life.

"There is a long-standing claim that the German Civil Code was postponed for almost a hundred years because of his opposition. ”

He is known as the "Newton of legal science", and his monumental work "The Contemporary Roman Legal System" is regarded as a benchmark by Chinese and foreign researchers.

He was an all-round jurist who studied many areas of jurisprudence throughout his life. It can be said that the words "Roman law", "German civil code", "German historical jurisprudence", "Pendecton school", and "the doctrine of legal relations" are all closely associated with his name.

He was called "the greatest jurist of the nineteenth century", "the founder of German jurisprudence" -

He is Savigny.

A course that has been taught repeatedly for 40 years has nourished generations of star-studded jurists

What is Jurisprudence?

What is legal interpretation, what are its elements, and what principles should be followed?

What is the system of jurisprudence?

How to read legal literature?......

These are all fundamental questions about the study and research methods of law, and in today's law schools, they belong to the "Must-Read for Studying Law" series. In Germany two hundred years ago, these questions were still new.

But Savigny knows how important they are.

Thus, in the 40 years from 1802, Savigny taught more than 30 courses on legal methodology at various universities on these basic issues. The clear, fluent, elegant, and insightful lectures attracted a large number of law students of the time, Vindersha, Homerle, Bloomer, Burshadi...... Many of them became famous jurists in later generations.

It can be said that this course of Savigny has directly influenced the growth of more than one generation of jurists. Carl Larenz once commented: "The modern doctrine of legal methodology, at least in the German-speaking world, originated with Friedrich Karl von Savigny." ”

The book I want to recommend to you today is to restore the star-studded course scene of two hundred years ago, take you to listen to the wonderful explanations of a generation of genius jurists, and feel the power of speculation and the profundity of law.

The importance of methodology to a discipline cannot be overstated. Savigny's book has been called "the foundation work of legal methodology". Larenz's "Legal Methodology" begins with a review of Savigny's legal methodology, which shows Savigny's pioneering position in the history of legal methodology.

After the first edition of this book in 2008, it was recommended by many university professors and was recommended by the reading clubs of famous law schools. It still maintains a high score of 8.9 on Douban.

"Reading a book from more than 200 years ago is really an amazing experience, like walking back in time and listening to Savigny on the stage on the methodology of law in the auditorium of the University of Marburg, and Green is sitting next to me......"

Few people know that the Brothers Grimm, who wrote the world-famous "Grimm's Fairy Tales", are actually German jurists. The eldest Jacob Green, who published "On the Poetry of Law", "German Legal Heritage", "Collection of Precedents" and other works, became one of the representatives of the Germanic branch of the historical law school by virtue of his outstanding research on the history of Germanic law, and was hired as a professor of law at the Berlin Academy of Sciences in 1840.

And one of his favorite courses during his time at the University of Marburg was Savigny's "Legal Methodology". In the course of legal methodology from 1802 to 1803, Green took detailed notes while listening to the lectures, and this note became an important record of the content of Savigny's lectures that year.

For this publication, we have made a left-right compilation. On the left is Savigny's lecture notes, and on the right are Green's lecture notes.

Recommended by famous experts

Karl Larenz (German jurist and author of The Methodology of Jurisprudence):

The modern doctrine of legal methodology, at least in the German-speaking world, originated with Friedrich Karl von Savigny.

Wilhelm Fergentreig (German jurist and author of Friedrich Karl von Savigny's Influence on the Doctrine of Transfer):

Savigny's legal methodology had a more significant and far-reaching impact on the legal profession than the later Contemporary Roman Law System.

Yang Daixiong (Professor, School of Law, East China University of Political Science and Law, author of "Theory of Legal Behavior" and "General Theory of Civil Law"):

The main significance of Savigny's legal methodology lies in understanding how the "brain" of a nation's jurisprudence develops, learning how to deal with the relationship between change and tradition, reason and history, local and foreign, politics and science, and understanding what scholars should do in the growth period of a nation's jurisprudence, how to "produce" the production method of law, and how to make law embark on the road of "science".
