In October 2023, Zhang Moumou planted the suspected poppy seeds he got from his father (deceased) on the roof of his house to be eaten in hot pot.
In February 2024, the police of the Taijiang County Public Security Bureau found it through drone aerial photography at work, and conducted a search in accordance with the law, and seized a total of more than 900 suspected opium poppy plants on the roof of Zhang's house.
After identification, codeine, morphine and other components were detected in the suspected opium poppy original plant planted by Zhang. On April 1, 2024, the Taijiang County People's Procuratorate charged the defendant Zhang Moumou with the crime of illegally cultivating the original plant of narcotics, and initiated a public prosecution.
The Taijiang County People's Court held at trial that the defendant Zhang XX illegally planted more than 900 opium poppies, and his actions constituted the crime of illegally cultivating narcotic plants. Therefore, in accordance with the provisions of Article 351, Paragraph 1 (1) of the "Criminal Law of the People's Republic of China", and on the basis of the defendant's truthful confession of his crime after being brought into the case, and voluntarily admitting guilt and accepting punishment, and other legally prescribed mitigating and lenient circumstances, he was sentenced to six months imprisonment, suspended for one year, and fined 3,000 RMB.

Article 351 of the Criminal Law of the People's Republic of China [Crime of Illegally Cultivating Narcotic Plants] Illegal cultivation of opium poppy, marijuana and other narcotic plants shall be forcibly eradicated. In any of the following circumstances, a sentence of up to five years imprisonment, short-term detention or controlled release is to be given, and a concurrent fine:
(1) Planting 500 or more opium poppies but less than 3,000 or a relatively large number of other narcotic plants;
(2) Planting again after being handled by the public security organs;
(3) Resisting eradication.
Whoever illegally cultivates 3,000 or more opium poppies or other narcotic plants in large quantities shall be sentenced to fixed-term imprisonment of not less than five years and shall also be fined or have his property confiscated.
Illegal cultivation of opium poppy or other narcotic plants may be exempted from punishment if they are automatically eradicated before harvesting.
