The child encounters bullying at school

What parents should do

Zhao Hui, a lawyer at Beijing Zhicheng Law Firm and director of the Education and Juvenile Protection Committee of the Beijing Lawyers Association, said that in reality, if their children are bullied on campus, even if the school cannot solve the problem, parents should choose other legal channels, such as calling the police or complaining to the higher education authorities.

For example, the "Regulations on the Protection of Minors in Schools" promulgated by the Ministry of Education in 2021 requires that schools should establish a student bullying governance organization. Schools should promptly report serious bullying to the education department and public security organs. At the same time, psychological counseling, education and guidance are provided to the bullied.

In Zhao's view, calling the police may be a more effective way. Because after calling the police, the police will find parents, teachers, and schools on both sides to record statements and fix the evidence. After ascertaining the facts, if the bully constitutes a public security offense or even a criminal offense, the police can directly punish him or transfer him to the judicial organs; if the circumstances are relatively minor, the police can also criticize and educate the parents and ask them to supervise the children to stop bullying, and they can also take educational and corrective measures against children who have serious negative behaviors. In addition, the police investigation process is a warning to parents and the school itself, and can draw attention to the problem. If parents want to file a civil lawsuit, they can also file a lawsuit directly with the court on the basis of the evidence collected by the police, demanding that the other party stop the infringement, apologize, and compensate for losses.
