How outrageous are village and town cadres?
- In the face of reporters' visits, they kept saying that they didn't understand the law, but they used the "Civil Code" everywhere to put pressure on farmers;

Overview of the event
On April 22, 2024, China Sannong released two interview videos to expose the story behind "not allowing farmers to plough in spring".

It was the critical moment of spring plowing in Northeast China, and the peasants were angry and didn't fight anywhere, and when they saw the reporter, they saw it like a savior, and told all the grievances in their stomachs:
- If you don't plough the land now, it's too late, time waits for no one, there is a cycle for crop growth, if the crops are not ripe, isn't the land in vain?
As early as 2004, Lao Zhang and more than a dozen villagers together won more than 5,000 acres of land in front of him, the contract is valid for 30 years, originally in early April should have loosened the soil for spring sowing, never expected, this year is an accident.
The village council gives the following requirements:
Either pay 200 yuan per acre of land, or don't let spring planting, someone is here 24 hours a day, as long as the countryside turns over the soil, someone will come to stop it.
In order to confirm this statement, some villagers drove a bulldozer in front of reporters......
Sure enough, a village cadre came within a few minutes, and directly angrily scolded the villagers, either pay the money, or refuse to allow farming, you choose for yourself!
Seeing such a scene, the villagers asked again and again, "When you take out the legal provisions, which law is collecting money?" Who asked you to collect the money, and what kind of money did you pay?
Some farmers at the scene complained to reporters:
- I don't give an explanation, I can't say a document, I ask what I want to collect from above, you must know that the 30-year contract fee has been paid in full as early as 2022, why is there a second charge?
With continuous in-depth interviews, the reporter finally found that the problem was the nature of the land at the beginning of the contract in 2004:
At the time of the signing of the contract, there were only 110 acres of arable land, and the rest of the land was pasture, which means that "it was originally used to raise cattle." ”
The contractor also added:
Among the nearly 6,000 acres, most of them are saline-alkali land, the kind that does not grow an inch of grass, and there is no way to grow crops, so the agreed price of the contract signed by the two parties at that time was not high.
In order to better grow pasture, in the past ten years, growers have begun to spend money to improve this large area of land, using cow dung and forage recycling to transform it......
After nearly 20 years of hard work by growers, the current scene has been created, and it has changed from "planting pasture" to "planting corn and other crops in water".
Because of this, the village committee began to collect money again, and now everyone's money is used to improve the land and buy seeds and fertilizers, how can they have the money to pay for this?
The attitude of the village council
The reporter then went to the village committee to see if what the village cadres said was consistent with the villagers.
The village cadres also admitted that when the contract was signed, it was really impossible to grow grain, not only were the potholes uneven, but there was not even a water source or facility......
- At the beginning, they contracted "grassland", but now it has become "watered land", and the use of land has changed!
At present, there are two options, either the contractor pays the money, or both parties terminate the contract.

The attitude of the town
The reporter came to the town again to look for an answer, but the town excused himself and said, "They didn't organize it." ”
However, in one video:
Ji Yunhao, who claimed to be a deputy cadre of the town party committee, stopped the contractor from driving a farm truck to overturn the land at the scene, and also brought a police car to arrest people.
In addition, the town also replied that by the time of the land survey in 18, the land there had been changed from wasteland to arable land, and the land had increased in value, so it was natural to increase their contract fees.
So, is the town's claim plausible?
Subsequently, Dr. He Wenjie of the China Law Society gave his opinion:
The town's statement is based on "the land has changed", but the premise of the change is not because of "natural conditions" or "related policies", but because the contractor has changed the land with cow dung and pasture, and then bulldozed and buried it, and finally turned it into the watered land it is today.
This is the result of more than ten years of hard work by the contractor!
In addition, it is clearly written in the contract that the village committee should be "foreseeable" about such an outcome, and the village committee should bear the risk instead of transferring it to the contractor.
In other words, since they agreed to open up the land, now it has become "watered land" because the village committee did not think of it at the beginning, and can only bear the consequences by itself.
The most important point is that the Rural Land Contract Law and the Civil Code are placed together, the former has a priority effect, and the contractors should be protected by the law after the improvement of the watered land by the contractors.
One stone stirs up a thousand waves
After the video of China's three rural areas was broadcast, the local government issued a notice overnight:
No matter what the reason, we must not delay the peasants from planting the land, because the mainland is a big agricultural country, and the biggest law is food security.
The village cadres keep saying that they don't understand the law, but they use the Civil Code to put pressure on reporters, and such leaders are really disappointing.
