The China Trademark Association has conducted a systematic and in-depth analysis and combing of the whole chain of trademark creation, application, protection, management and service, and extracted 38 core issues. In order to conduct in-depth research on these topics, the association actively mobilized and gathered more than 230 industry experts from 84 units, including member units, universities and research institutions, in January 2023, and established 38 trademark research groups to officially launch the research work. In the past year, all thematic groups have actively invested and worked together to achieve phased research results, successfully completed the annual research tasks, and finally formed more than 40 special research reports with both theoretical depth and practical guidance value.
On April 17, the "Research Report Release and Exchange Meeting on Frontier Issues of Trademark Law" was held in Beijing. Ma Fu, President of China Trademark Association, and Jin Yan, Second-level Researcher of the Supreme People's Court, attended and delivered speeches. Wu Dongping, Secretary-General of the China Trademark Association, released the research results, and Du Ying, a professor at the Central University of Finance and Economics, made expert comments. The first, second and third prize representatives of the thematic group made keynote speeches based on the research results of their respective teams. Jiang Qi, assistant to the president of the China Trademark Association, presided over the event.
In his speech, Ma Fu said that the association's launch of the special group on frontier issues of trademark law is an important measure to actively respond to and implement the national innovation-driven development strategy and the strategic deployment of building an intellectual property power, promote the implementation of the trademark brand strategy, and give full play to the association's national professional platform in the field of trademarks. Since its launch, it has received extensive attention and positive response from all walks of life. After a year of hard work, the thematic group has achieved remarkable results. Today, we are gathered together to witness the official release of these research results. This is not only an affirmation of the hard work of every expert involved in the special research, but also a high recognition of the work of the association. Looking forward to the future, the association will continue to uphold the purpose of serving members and the industry, and deepen cooperation and exchanges with all sectors of society. We will give full play to our role as a bridge to promote the continuous improvement of the mainland's trademark legal system and the continuous improvement of the level of trademark protection.
In her speech, Jin Yan said that excellent judicial adjudication is inseparable from the nourishment of research results. The three themes discussed and the more than 40 research reports published at the conference were closely related to the cutting-edge issues in the field of trademarks in the era of digital economy.
At the meeting, Wu Dongping released the 2023 outstanding research results and the list of outstanding co-chairs of the research group on frontier issues of trademark law. He introduced that the relevant research results will be published in the magazine "China Trademark" for the reference and learning of readers, and looks forward to everyone's attention and support.
Professor Du Ying, as the representative of the guiding experts of the special group, made in-depth and detailed comments. She pointed out that it is an important and vast project for the association to carry out the research work of the special group. The topic selection is not only cutting-edge, but also covers all aspects of the trademark legal system. If the research is done well, the theoretical and practical problems of the trademark legal system will be answered, especially the hot issues that have been of special concern to all sectors of society in recent years. She further pointed out that from the research results submitted by each group, each group follows the principle of being based on China's reality and national conditions, comparing the current situation of system operation, extracting key issues, learning from foreign experience, and providing systematic solutions and suggestions through systematic analysis. The core guidelines for the application of law and market behavior, whether from the perspective of institutional construction, practical operation, or even academic analysis, are of great significance, and are also important materials for theoretical observation.
In the theme sharing session, Jin Gaoping, co-moderator of the Commodity and Service Classification Research Group and Brand Legal Director of Alibaba Group, Li Xiang, co-moderator of the Trademark Infringement Research Group and lecturer of Tianjin Polytechnic University, and Yu Wenzhu, co-host of the Trademark Research Group under Web3.0 and partner of Beijing AnJie Broad & Bright, shared the research results and experiences of their respective teams as the winners of the first, second and third prizes respectively. Focusing on trademark issues in the Internet environment, the three experts discussed in depth the "Impact and Challenges on the Classification Rules of Goods and Services under the Development Trend of the Digital Economy", "Trademark Protection Rules under Virtual Reality Technology", and "Product Descriptions and Product Similarity Issues Related to the Metaverse". They hope that by participating in the research work of the special group, they will deeply integrate theoretical research with their own practice, contribute constructive opinions and suggestions to the improvement and progress of the trademark legal system, and at the same time, provide a valuable basis for government decision-making and enterprise practical work.
Finally, the two leaders, Ma Fu and Wu Dongping, jointly awarded honorary certificates to the representatives of the special award, the first prize, the second prize, the third prize and the outstanding co-host.
More than 100 people attended the event, including cadres from relevant departments of the State Intellectual Property Office, the Department of Strategic Planning, the Department of Intellectual Property Protection, the Department of Intellectual Property Utilization, the Department of Public Service, and the Trademark Office, as well as experts in the guidance of the special group, co-hosts, members, and representatives of member units.
