Guangzhou Nansha New Area Pearl Bay Area Start-up Area Phase II (Hengli Island Tip) Land Development Project - North of the Central Axis Chung Phoenix Avenue West Municipal Road Project Three Road Sections, located in Hengli Town, Nansha District, Guangzhou City, urban secondary trunk road, standard road width 30.00m, length 1112.06m, the main construction content includes: roads, bridges, drainage, lighting, power pipe ditch, traffic, greening and other projects.

The scope of this plan is the houses and factories on the state-owned land involved in the land use of Sanduo Road, such as No. 4 (factory building) on Dongyi 1st Street, Hengli Town, Nansha District, No. 7 (factory) on East 2nd Road, Hengli Town, Nansha District, No. 13 (commercial service) on Hengli Road, Hengli Town, Nansha District, etc., and other houses and factories on state-owned land that are not listed in the house number, and the specific scope of expropriation is subject to the red line of the project.

Expropriation compensation and resettlement objects

  • The owner of the expropriated house and its ancillary facilities who has a legal real estate title certificate within the scope of expropriation;
  • Users of temporary structures that have not exceeded the approved period of use;
  • Users of houses that have not been registered for property rights, such as historical buildings.

Expropriation compensation and resettlement methods

(1) For residential buildings on state-owned land, the expropriated person may choose monetary compensation or property rights exchange.

Monetary compensation

Monetary compensation shall be made according to the unit price of the market assessment, and the base date of the assessment shall be the date of the announcement of the expropriation decision.

Swap of property rights

(1) The project can implement the principle of nearby resettlement, and resettle the expropriated houses within the same town (street) area.

(2) The property rights shall be exchanged in accordance with the Suinan Fu Gui [2019] No. 2 "Guiding Opinions on the Expropriation and Compensation of Residential and Commercial Buildings on State-owned Land Transferred in Nansha, Guangzhou".

(2) According to the relevant housing expropriation policy and the actual situation of the project, monetary compensation shall be implemented in principle for the non-residential houses on the state-owned land involved in this time. If the recovery of the right to use state-owned land involves the expropriation of roads, it shall be implemented in accordance with the relevant laws and regulations.

Residential Housing Relocation Subsidy Standard

For the expropriation of residential houses on state-owned land, according to the number of registered population of the expropriated person, the relocation subsidy (including the relocation expenses, equipment relocation, installation, commissioning and other relocation expenses) shall be given to the expropriated person according to the number of registered population of the expropriated person, but the total amount of the relocation subsidy shall not exceed 9,000 yuan per household.

If the total amount of relocation subsidy of the levied person is less than 5,000 yuan per household, the relocation subsidy will be given at 5,000 yuan per household.

Residential Housing Incentive Fee Standards

Incentives for the expropriation of residential houses and the time limit for relocation: According to the nature of the land involved in the expropriated houses, they are respectively in accordance with the Suinan Fu Gui [2019] No. 2 "Guiding Opinions on Compensation for the Expropriation of Residential and Commercial Buildings on State-owned Land Transferred in Nansha, Guangzhou".

Placement of the property

(1) Existing housing

The housing expropriation department provides the existing self-owned resettlement houses within Hengli Town for the exchange of property rights of the expropriated residential houses.

(2) The expropriated persons of residential houses on state-owned land may choose off-plan housing, and if they choose off-plan housing, before the allocation of resettlement housing, according to the determined area of replacement resettlement housing, a temporary resettlement subsidy of 15 yuan/square meter/month will be given.

Housing Appraisal

Within 30 working days after the announcement of the housing expropriation decision, the expropriated person shall negotiate and select a real estate price appraisal agency, and the housing expropriation implementation unit shall sign an entrusted appraisal contract with it to carry out the appraisal operation.

If the decision to expropriate the housing within 30 working days after the announcement of the negotiation and selection, the housing expropriation implementation unit shall organize the expropriated person to be randomly determined by shaking the beads in the list of assessment agencies published by the municipal housing and urban-rural construction administrative department.

The housing expropriation implementation unit shall, within 5 days before the lottery of the balls, announce the time and place of the shaking of the beads within the scope of the expropriation. When the beads are shaken publicly, they shall be notarized on the spot by the notary department.

The housing expropriation implementation unit shall publicize the entrusted real estate price appraisal agency qualification certificate, business license, and copy of the qualification certificate signed by the registered real estate appraiser himself within the scope of expropriation.

The time point of assessment of the value of the expropriated house is the date of the announcement of the decision to expropriate the house.

Compensation for owned homes

Houses with property rights shall be assessed in accordance with the real estate price appraisal agency with relevant qualifications announced by the municipal housing and urban-rural construction administrative departments, and the housing expropriation compensation agreement shall be signed according to the housing appraisal price, and the assessment fee shall be paid by the housing expropriation implementation unit.

Other compensation for non-residential premises

Reimbursement of relocation costs

For the expropriation of non-residential houses on state-owned land, the relocation fee shall be determined according to the assessment, including the dismantling fee, removal fee, installation fee, commissioning fee of machinery and equipment, and the inability to do so after relocation

Expenses such as the cost of replacing production equipment that has been restored to service.

Compensation for loss of production and business suspension

The compensation for the losses caused by the expropriated person's suspension of production and business due to the expropriation of the house shall be determined on the basis of factors such as the benefits of the house before the expropriation, the period of suspension of production and business, and other factors.

Among them, the benefits before the expropriation of the house shall in principle be subject to the actual average monthly after-tax profit within one year before the decision to expropriate the house, and if the tax payment situation and other proofs cannot be provided or the after-tax profit cannot be calculated, it shall be calculated according to the average after-tax profit of the same industry in the region in the previous year or the market rent assessment of the same type of housing.

The period of suspension of production and business is calculated as 6 months. If the production or business unit or individual of the expropriated house is not the person subject to expropriation, the person subject to the expropriation shall be liable for the removal of the expropriated house. If there is a contractual agreement between the expropriated person and the production or business unit or individual, the expropriated person shall distribute the compensation for the loss of suspension of production and business in accordance with the agreement, and if there is no agreement, the expropriated person shall negotiate with the production or business unit or individual to distribute the compensation.

Temporary Placement Fee

Referring to the reference price of the rent of the same type of house in the location of the expropriated house recently announced by the municipal housing and urban-rural development administrative department, a one-time payment of 3 months of temporary resettlement fee shall be made to the expropriated person according to the confirmed area of the expropriated house.

Compensation rates for buildings that are not registered with property rights

(1) For temporary buildings and other ancillary facilities that have not exceeded the approved period, if the construction basis and invoices can be provided, the remaining service life compensation shall be calculated according to the construction cost, and if the construction basis and invoices cannot be provided, the appraisal company shall be entrusted to compensate for the new appraisal value according to the replacement combination.

(2) No compensation shall be given to buildings that have not been registered for property rights and are found to be illegal buildings or temporary buildings that exceed the approved period.

(3) Buildings that do not fall under the circumstances of the first and second paragraphs without property rights registration, and where the following circumstances exist, monetary compensation shall be given.

  • For buildings built before January 1, 1967 without property rights registration, the housing expropriation implementation unit shall pay monetary compensation according to the property rights house.
  • Buildings constructed between 1 January 1967 and 31 December 2009 without property registration shall be compensated at the rate of 60 per cent of the compensation price of the property right house if the survey and topographic map of the area for that period is checked and confirmed.
  • After December 31, 2009, no compensation will be made for the additional area of the above-mentioned confirmed buildings.

(4) Other compensation items not included in the above compensation shall be subject to the assessment results.

Resumption of state-owned land use rights

Compensation standard for temporary land borrowing

(A) State-owned land without housing reference land in the same area and lot, the same nature of use of the State-owned land benchmark land price, by the corresponding qualification of the appraisal agency for valuation, according to the assessment results of the implementation of compensation, State-owned land use rights at the same time recovery. If the land use right is recovered by the government without compensation, it shall be implemented in accordance with relevant provisions.

(2) Compensation for temporary construction outside the red line of land acquisition. If the land borrowed for temporary construction outside the red line of land acquisition is actually used before borrowing, the real estate price appraisal agency with corresponding qualifications shall conduct appraisal to determine the unit price (including tax) of land borrowing compensation. If the assessed compensation fee for borrowing land does not include the cost of site restoration, the user unit shall be responsible for restoring the original state within 30 days after the completion of the borrowed land and return it to the ownership unit after passing the acceptance by the land law enforcement department.

(1) If the parties to the dispute fail to resolve the expropriation within the expropriation period, the housing expropriation implementation unit shall notarize the evidence preservation of the expropriated house and the deposit of the expropriation compensation fee to the notary public, and the housing expropriation department shall report to the Nansha District People's Government to make a compensation decision in accordance with this plan, and make an announcement within the scope of housing expropriation.

(2) If the mortgagor and the mortgagee do not reach an agreement on the disposal of the housing compensation fee within the expropriation period, the housing expropriation implementation unit shall handle the notarization of the evidence preservation of the expropriated house and the deposit and withdrawal of the expropriation compensation fee to the notary public, and report to the Nansha District People's Government to make a compensation decision in accordance with this plan, and make an announcement within the scope of housing expropriation.

(3) If it is not included in the above-mentioned compensation items, it shall be implemented in accordance with the spirit of the relevant documents of Guangzhou City and Nansha District.

(4) This compensation plan is formulated in accordance with the Regulations on the Expropriation and Compensation of Houses on State-owned Land, the Notice of the Guangzhou Municipal People's Government on Printing and Distributing the Implementation Measures for the Expropriation and Compensation of Houses on State-owned Land in Guangzhou (Sui Fu Gui [2021] No. 2), and the Guiding Opinions on Compensation for the Expropriation and Compensation of Residential and Commercial Buildings on State-owned Land in Nansha, Guangzhou (Sui Nan Fu Gui [2019] No. 2) and other provisions, and has been formulated in accordance with Sui Fu Gui [2021] 2 Article 14 of the document stipulates that public comments shall be solicited on the government portal website (http://www.gzns.gov.cn) and the on-site announcement of housing expropriation.

This plan shall be implemented from the date of issuance.
