The Regulations on Disciplinary Punishment of the Communist Party of China stipulate that persons responsible for disciplinary violations can be divided into those directly responsible, those with primary leadership responsibility, and those with important leadership responsibility. The distinction between these three is as follows-

(1) Persons directly responsible

refers to Party members or leading cadres who do not perform or incorrectly perform their duties within the scope of their duties, and play a decisive role in the losses or consequences caused.

"Within the scope of duties" mainly refers to the specific work responsibilities and obligations that should be undertaken in accordance with their statutory duties or assigned by the organization. "Failure to perform duties" is generally manifested in the inaction of an act that should be done, such as refusal to perform duties, delay in performing duties, or leaving one's duties without authorization;

(2) Persons with primary leadership responsibility

Refers to leading cadres who do not perform or incorrectly perform their duties for the work of their supervisors within the scope of their duties, and bear direct leadership responsibility for the losses or consequences caused.

"The work of the supervisor" mainly refers to the work for which there is a clear division of labor or the Party organization assigns responsibility and jurisdiction to it. Compared with the provisions of the 2018 "Regulations", the word "direct" in the "work of direct supervisors" has been deleted in this revision, which adapts to the actual situation of the division of labor among the leading groups, and at the same time solves the problem that some leading cadres in the past raised objections to whether they are not directly in charge and do not meet the conditions for assuming the main leadership responsibilities.

(3) Persons with important leadership responsibilities

refers to leading cadres who do not perform or incorrectly perform their duties in the work they should manage or participate in decisions within the scope of their duties, and bear secondary leadership responsibility for the losses or consequences caused.

"Work that should be managed" mainly refers to the work that should be under its responsibility and jurisdiction in accordance with the statutory scope of duties, although there is no clear division of labor and it is in charge. "Participation in decision-making" refers mainly to work that should be decided by two or more people through discussion, or by collective discussion.

Where a leading Party cadre directly decides on a specific issue or specific matter, or where a leading Party member leading cadre instructs or directs the undertaking personnel to handle (or should not handle) the relevant matter in violation of regulations, or where the specific implementation personnel have put forward corrective opinions in the course of implementation, but have not been adopted by the Party member leading cadres and have caused economic losses or negative impacts, the Party member leading cadres may be found to be directly responsible.
