Announcement on the selection of people's assessors

On the basis of the provisions of the "People's Assessors Law of the People's Republic of China", people's assessors are specially selected and appointed openly to the public, so as to ensure the smooth development of people's assessor replacement work, to ensure citizens' lawful participation in trial activities, and to promote judicial fairness and openness. The relevant matters are hereby announced as follows:

1. Elective quotas

The number of people's assessors selected this time is 27, of which 5 are applied for or recommended.

2. Election requirements

(1) Citizens serving as people's assessors shall meet the following requirements:

1. Support the Constitution of the People's Republic of China;

2. Be at least 28 years old (as of March 24, 2024);

3. Law-abiding, good conduct, fairness and decency;

4. Have the physical condition to perform duties normally.

Serving as people's assessors shall generally have a high school education or higher.

(2) The following persons cannot serve as people's assessors:

1. Constituent members of the Standing Committee of the People's Congress, and staff of the Supervision Commission, the People's Courts, the People's Procuratorates, the Public Security Organs, the State Security Organs, and the Judicial-Administrative Organs;

2. Lawyers, notaries, arbitrators, and grassroots legal service workers;

3. Other persons who are not suitable to serve as people's assessors due to their duties.

(3) In any of the following circumstances, they must not serve as people's assessors:

1. Those who have received criminal punishment;

2. Those who have been dismissed from public office;

3. The lawyer's or notary's practice certificate has been revoked;

4. Being included in the list of judgment defaulters;

5. Those who have been removed from the position of people's assessor because they have been disciplined;

6. Other serious violations of law or discipline that might impact judicial credibility.

Citizens must not serve as people's assessors in two or more basic level people's courts at the same time.

3. Rights and obligations and term of office

Citizens have the right and obligation to serve as people's assessors in accordance with law. People's assessors lawfully participating in the trial activities of the people's courts have the same rights as judges, except as otherwise provided by law. People's assessors enjoy the rights to participate in trial activities, to independently express opinions, and to obtain safeguards for the performance of their duties, and at the same time shall comply with obligations such as faithfully performing trial duties, keeping trial secrets, paying attention to judicial etiquette, and preserving the judicial image.

The term of office of people's assessors is five years, and they generally must not be re-elected, and citizens must not serve as people's assessors more than twice.

IV. Treatment of people's assessors

(1) During the period when people's assessors participate in trial activities, their units must not deduct or indirectly deduct their salaries, bonuses, or other benefits;

(2) During the period when people's assessors participate in trial activities, the people's courts are to give subsidies in accordance with relevant provisions;

(3) The people's courts are to give subsidies in accordance with relevant provisions for expenses such as transportation and meals incurred by people's assessors as a result of participating in trial activities.

V. Methods for selecting people's assessors

There are three types of methods for selecting people's assessors: random selection, individual application, and organizational recommendation, with random selection being the main method. The Pingnan County Bureau of Justice, in conjunction with the Pingnan County People's Court and the Pingnan County Public Security Bureau, is to randomly select persons to be appointed more than 5 times the number of people's assessors as people's assessor candidates from the list of permanent residents who are 28 years old or older in the jurisdictional area, to conduct a review of the qualifications of the people's assessor candidates, and solicit the candidates' opinions.

As needed for trial activities, candidates for people's assessors may be selected through individual applications and recommendations from their units, basic-level mass autonomous organizations, or people's organizations for their place of household registration or habitual residence. Where citizens apply to serve as people's assessors, they shall, in accordance with the requirements of the selection announcement, submit written materials such as proof of identity and academic qualifications to the county judicial bureau or territorial judicial office for the place of their household registration or habitual residence, and fill out the "Application Form for People's Assessor Candidates"; The Pingnan County Bureau of Justice, in conjunction with the Pingnan County People's Court and the Pingnan County Public Security Bureau, is to conduct a qualification review of individual applications and people's assessor candidates recommended by the organization.

6. Determine the candidates to be appointed

The Pingnan County Bureau of Justice, in conjunction with the Pingnan County People's Court, is to randomly select some candidates for people's assessors from the list of candidates who have passed the qualification review and agree to serve as people's assessors, and at the same time determine the candidates to be appointed as people's assessors from among the people's assessor applicants and recommended persons who have passed the qualification review. People's assessors selected by individual applications and organizational recommendations must not exceed one-fifth of the number of people's assessors in the Pingnan County People's Court. Where the number of individual applicants or organizational recommendations exceeds the number of people to be appointed, the candidates to be appointed may be determined by random selection among the applicants and recommended persons who have passed the qualification review.

7. Publicity, appointment, and oath

(1) The Pingnan County Bureau of Justice, in conjunction with the Pingnan County People's Court and the Pingnan County Public Security Bureau, is to announce to the public the list of people's assessors to be appointed, and the publicity period is not less than 5 working days.

(2) The candidates to be appointed after the announcement shall be submitted by the president of the Pingnan County People's Court to the Standing Committee of the Pingnan County People's Congress for appointment.

(3) After the appointment of the Standing Committee of the Pingnan County People's Congress is approved, the oath of office shall be held publicly. The oath-taking ceremony was organized by the Pingnan County People's Court in conjunction with the Pingnan County Bureau of Justice.

8. Registration

1. The application form for people's assessor candidates or the people's assessor candidate recommendation form (in triplicate) can be obtained directly from the Promotion of the Rule of Law Unit of the County Judicial Bureau, or downloaded from the Pingnan County People's Government website http://www.pingnan.gov.cn/ Information Disclosure - Notice Bulletin Board below this announcement and printed on both sides);

2. The original and photocopy of the identity certificate such as ID card and household registration booklet, and the relevant permanent residence certificate materials (in triplicate) for non-local household registration;

3. The original and photocopy of the academic certificate (in triplicate);
